Our little group enjoyed the remainder of our cruise before returning to Jason's Haven. Our time aboard 'Caribbean Angels' had changed us all. We looked at life from a new perspective and attacked it with a new zeal. Each of us had formed a stronger bond with our lovers, and our friends. It had been a time of deep reflection, growth, and renewed passions. In short, our cruise had indeed taken us to paradise. The boys returned to their regular school routine. Allen and I returned to the business of running Jason's Haven. The island had run without incident while we were away. A month after Paradise Cruise Lines opened for business, profits were coming in at a very good clip. Our numbers showed a huge increase in revenue over the next several months and the long range projections looked extremely good. It was time for some expansion on Jason's Haven. After years of faithful service to Jason's Haven, Allen was promoted to Director of Operations. When the latest report was issued by the U.S. Department of Health and Human Services, the number of homeless gay youth in America was estimated at over one hundred thousand. We could not help them all, but we were determined to help as many as we possibly could. Allen's first task in his new position was to develop, and implement, an expansion plan that would allow us to handle five hundred boys and two hundred customers on the island. Allen was given a three year window to complete the expansion. All areas of operations would have to be expanded to meet our goal. The expansion would include a new theater building, a surgical facility added on to the infirmary, a new dental center, increased water purification facilities, increased waste disposal facilities, doubling the quad runner fleet, construction of two soccer fields, construction of a massage salon, and construction of the Paradise Pizzeria. All of this on top of building a second dormitory building, doubling the customer cabanas, and adding on to the staff housing facilities. The expansion would require a rather large initial cash infusion from ESEI but it was desperately needed. James spent much of his time after school making sure that Paradise Cruise Lines continued to treat its customers like royalty. James maintained straight 'A's in school and his teachers had recommended him for our accelerated program. This put him on a course to graduate high school at age fifteen. Although he lacked real world experience, James proved himself to be a hard working and sharp business man. I was more proud of him than he could ever know, and our love deepened each passing day. The next two and a half years on the island were very busy, but also very fulfilling. All of the major expansion work was completed on schedule, and construction had begun on the 'James Simmons College of Business'. James had done extremely well in the accelerated program and would be graduating next year. With any luck, the University would be operational by then so James could be among its first students. Summer was nearing its end, and James' fifteenth birthday was less than a week away. My recovery trip schedule had me on the go constantly. With one hundred vacancies still needing to be filled, it showed no signs of letting up any time soon. James had grown very unhappy with all of the time we had to spend apart because of the recovery trips. Our Miami legal team had been working on James' legal status for a month now, at his request. James sought and received an exception from the Executive Staff to be escorted to Miami in order to receive a Declaration of Emancipation. Our Miami law office had James convinced that there would be no problems in obtaining the Declaration. I had explained the benefits and risks to James, but this was something he insisted on doing. It would mean he would be able to travel with me on the many trips I needed to take. But if Emancipation was denied, he would be immediately taken into the care of the State. It was not a risk 'I' would have taken, but James was very adamant on the matter. He had been told, from the day I first met him, that he was free to make his own choices. As we climbed aboard the jet to leave for Miami, I tried to mentally prepare myself for the possibility of another tragic loss in my life. When the plane touched down in Miami, I got out on the tarmac as usual. The plane was then taken to the hanger. James was then placed in a van and driven to a gas station just outside of the airport to meet up with me. Marcus drove us out to the residence and we were greeted by Mihai, Franklin, and seven year old Nicholas. When the hugs were all dispensed with, we all went into the house. We spent the afternoon catching up on our busy lives. Mihai and Franklin walked us over and gave us a tour of their home. I had seen it on a previous trip but James was seeing it for the first time. "You have a very lovely home Mihai and Franklin." James noted. "Thank you. I can not believe how much you have grown up, James." Franklin stated. Franklin was right. James had grown to a height of 5'8" tall and weighed in at just over one hundred and forty two pounds. He was still the most gorgeous creature I had ever seen and the looks he got from everyone he passed by told me I was not the only one who felt that way. "Have the legal papers arrived from the lawyer's office yet?" I asked Mihai. "They are over on your desk, Tim. James' wardrobe also arrived and is now hanging in the closet of the spare bedroom as you instructed." he replied. "Well, I guess we better head back. Let's all have dinner out tonight. You guys pick the place okay?" I asked. "I'm sure we can think of some place suitable." Franklin chuckled. James and I walked back over to the residence and went into my office. "What do those papers say?" James asked as I reviewed the documents. "This one is a notice of hearing on your emancipation. It will be held at 9:00am on August fifth." I said as I showed him the document. "And this one is an order granting me temporary guardianship of you until the legal matter is resolved." "So you're like my dad now?" he asked with a puzzled look. "No James. I am only your temporary guardian." I explained. "Good. It would be a little weird having sex with my dad." he joked. "Yes it would. It would also be a little weird to have sex with your guardian so that won't be happening." I stated matter-of-factly. "What?" he asked in shock. "Until the hearing, we are subject to surprise inspection. You will be sleeping in the guestroom and we will not be having any sex until this is over. I won't put you at any more risk than you have already put yourself." I explained. "The lawyer said this was just a formality, Tim. It's all going to be fine my love. I know it will." James said confidently. "I sure hope so, angel. Or I will have to pull off another rescue under the cover of darkness. If I lose you, it will kill me." I said in a worried voice. "Can we at least kiss?" James asked as he walked over beside me. "There is no law against kissing." I replied coyly. We locked in an embrace and kissed each other lovingly. "Alright then..." I said as my dick began to rise to the occasion. I quickly took my seat before continuing. "We have to get this schedule all worked out. We have the school and doctor tomorrow. Then we have to see the Psychiatrist on Saturday." "Psychiatrist? They're coming to take me away ahah hehe hoho..." he began singing jokingly. "Don't joke about this James!" I shouted. "This is very serious business! Our future is at stake here!" I exclaimed. "I'm really sorry Tim." he said with the look of a scolded puppy on his face. "I did not realize this was worrying you so much." I stood up and hugged him tightly. "I am sorry I shouted at you, angel. I am just so afraid of what could go wrong." I said as I broke down into tears. James kissed my tears away and whispered, "Nothing is going to go wrong, my love. We are going to be together forever." We walked out to answer the door and it was the police. "Are you Mr. Timothy Ryan Stevens?" the officer enquired. "Yes sir I am." I replied before he handed me a folded up piece of paper with the word 'Summons' in bold letters across the front. "This is an official summons to appear before Judge Margaret Thayer on Monday, August the fifth, at 9:00 AM." he stated. "Are you James Robert Simmons?" he asked as he pointed at James. "Yes sir." James replied. "You are also summoned to appear before Judge Thayer at the same time on August fifth." he said as he handed James his summons. "Thank you officer," I replied as I closed the door. I turned towards James with a look of uncertainty on my face. "Well, the chips are on the table, and the hand has been dealt. We 'have to' play this out now." "You are really freaking out about this whole thing aren't you?" James asked in a concerned tone. "Why did you agree to let me do this if it bothered you so much?" he asked. "You wanted the freedom to be able to come and go as you please. No person should ever have their freedom withheld from them, unless they hurt someone. It is one of the bedrock principles that our program is based on. You are not my property James, and I do not have the right to stop you from doing what you want to do. It's your life my love. You have to live it as you see fit. I can only stand by your side and offer my love and support." I said through my tears. James led me over to the couch, and sat down beside me. He wrapped his arms around me and held me tight. "We are meant to be together Tim. Can't you see that from all that has happened?" he asked. "No one will ever take me away from you, my love. No one!" James said optimistically. It has been my experience that an optimist is nothing more than a pessimist without experience. But there was no need to obsess over things which were now out of our hands. I regained my composure and stood up. "Let's go have a look at that wardrobe of yours." I said as I pulled James to his feet. We walked upstairs to the spare bedroom and I showed James an array of outfits and a couple of suits. I heard the front door open and slam closed. "Tim! Is everything okay? I saw a police car outside a minute ago." Mihai shouted out. "We're up here in the spare bedroom Mihai." I shouted back at him. A few seconds later, he bounded into the room with a look of panic on his face. "It's alright Mihai. They were just serving us a summons to court on Monday." I said as I put my hand on his shoulder. The three of us went downstairs and made sandwiches to tide us over until dinner. After we had eaten, Mihai went back to his house. James and I had Marcus drive us around Miami for a while since James had not seen the town in over three years. "It hasn't changed much since I've been gone." he said in disgust. "Some things never do James." I replied as we drove along. We arrived back at Mihai and Franklin's house at 6:30pm. When Mihai, Franklin and Nicholas got into towncar, Mihai handed Marcus the address to the restaurant. When we pulled into the parking lot I looked over at Mihai and said, "I thought it would be some swanky restaurant." "You have a problem with the Outback?" he asked impertinently. "No, not at all Mihai," I chuckled as we climbed out of the car. We had an enjoyable meal and Mihai took the check before I could get my hands on it. Mihai paid the bill and we went back out to the towncar. We drove back to the residence and Marcus dropped us off. When it was time for bed, I kissed James and hugged him before saying goodnight. It dawned on me that the last time James spent the night in this house, he slept in my bed with me. I could only hope that the same would be true on the last night of this trip. We spent the day on Friday getting James tested by State Officials and by Dr. McKinney. I was not permitted to know the results of the testing since the court had requested them. The court had allowed us to use Dr. McKinney for the James' physical examination since he was my family doctor. This was a huge break for us. A doctor that was not very discrete would have sunk been a major problem for us. Almost four years of anal sex with men is not exactly unnoticeable. I fixed us dinner at home and we spent a quiet evening together just cuddling in the media room. The weekend was very busy between an all day visit at the Psychiatrist's office on Saturday and James' muted birthday celebration on Sunday. I promised James a real birthday celebration if everything turned out in court as we hoped it would. James seemed to be a little nervous when I kissed him goodnight Sunday night. I was more than a little nervous. We hugged for a long time before finally heading to bed. We rose early Monday morning to dress for court. James wore one of his new suits and he looked like a million bucks. We grabbed a bite at McDonalds on the way to the Miami-Dade County Courthouse. We met with our attorney, Michael Spicer, before heading into the courtroom. He informed us that we had not drawn the best judges by being assigned to Judge Thayer's courtroom. She was not an easy judge to get an emancipation from, but at least she was fair. "So much for boosting my confidence level" I thought, as the lawyer spoke. As we walked into the courtroom, James and our lawyer sat at a table on the left. Seated at the table on the right was a very well dressed woman, and a man I assumed to be the State's lawyer. I sat in the gallery to watch the hearing and wait for my turn to address the court. The bailiff took his position beside the Judge's chamber door and began to speak. "Oyez, Oyez, Oyez. The Eleventh Circuit Court of Miami-Dade is now in session. The Honorable Judge Margaret Thayer presiding. All those with business before this honorable court, draw near and you shall be heard. All rise." Everyone stood as a very serious looking judge took her seat. She wrapped her gavel on the bench before speaking. "You may be seated. Will the Clerk please read the docket." "Case number 504-0089, James Robert Simmons versus the State of Florida. The Plaintiff petitions the court for a Declaration of Emancipation." the clerk read. "Do all parties have legal representation?" the judge asked. "Michael Spicer representing the plaintiff, Your Honor." Michael stated, after standing to his feet. The State's attorney rose and stated, "Gavin Pendigrass representing the State of Florida, Your Honor." "Gentleman, I have read your briefs and am familiar with the petition before this court. Mr. Spicer, your client bares the burden of proof, so you may present your case first." "Thank you Your Honor." Michael began. "If it pleases the court, I call the plaintiff, James Robert Simmons, to the stand." James walked up to the witness stand and stood while he was sworn in. After taking his seat, Michael began the questioning. "Please state your name and current address for the record." "James Robert Simmons. 48796 Dorothy Circle, Miami." James replied. "Do you live with your parents at this address?" Michael asked. "No sir. My parents are deceased." James responded. "And how is it that you were not placed in the care of the state when your parents died?" Michael asked. "My parents were killed by a drunk driver over two and one half years ago. I was not living with them at the time. They had kicked me out of the house almost a year before then." James replied. "And how did you find out about your parent's death?" Michael asked. "A friend told me he had heard it on the news. That same friend later verified that it was my parents that had been killed." James replied. "And how have you survived on your own for almost four years?" Michael asked. "A social worker with Care for Kids found me living on the streets. He told Mr. Stevens about my situation and Mr. Stevens let me do chores to earn money." James replied as he smiled back at me. "Mr. Stevens? Would that be the same Timothy Ryan Stevens who is currently your temporary guardian?" Michael asked. "Yes sir." James replied. "Can you tell the court why you seek emancipation, James?" Michael asked. "I have been without parents to care for me since I was eleven years old. I have had to do whatever I could to make money. I would just like the opportunity to finish my education and get a real job so I can take care of myself." James said. "Do you have a prospect for a job, James?" Michael asked. "Yes sir. Mr. Stevens' company offered me a job. I just need this paper to make it legal for me to work." James replied. James stepped through the questions like a pro. So far he had not perjured himself in any way. "I have no further questions at this time, Your Honor." Michael stated before taking his seat. "Mr. Pendigrass, does the State wish to question this witness?" the judge asked. "Yes Your Honor. We have a few brief questions." Gavin answered. "James, you said that your parents kicked you out of the house. Can you tell us why they would do something like that?" "They found out I was gay, and they said I was not their son anymore." James answered with a tear in his eye. "I know this is difficult for you, but can you tell us exactly how you knew you were gay at eleven years old?" Gavin asked. "Because I had a boyfriend for almost a year. We kissed a lot and I had no interest in girls." James replied. "And how did your parents find out you were gay?" Gavin asked. "My dad caught me and my boyfriend together in my bedroom. We had been kissing." James replied. James was proving what a very sharp kid he was. He had not told a single lie on the stand. He was required to offer no more than was directly asked of him. "And you now feel you are mature enough to look after yourself?" Gavin asked. "Yes sir. I have done so for almost four years already." James answered. "Thank you, James. The state has no further questions for this witness, Your Honor." Gavin stated as he took his seat. "Any rebuttal Mr. Spicer?" the judge asked. "No, Your Honor. I have no further questions for this witness." Michael stated before sitting back down. "You are excused young man. You have the sympathies of this court for the loss of your parents." the judge said. "Thank you, Your Honor." James said as he returned to his seat at the table. To be continued...
