Chapter 55 Charlie pitched his usual fit about how he had to go to school, while Kyle didn't. Rick, for what felt like the millionth time, explained that Kyle had to go to court, and was not going to have any fun. Even when Kyle came out wearing a tailored, dark blue suit, Charlie was less than impressed with his dad's excuse. "Why do I have to wear this?" Kyle said, fidgeting with the tie. Will moved Kyle's hands and adjusted the tie for his son. "Because, you want the jury to take you seriously, and they won't believe you if you show up wearing a comic book, t-shirt and ratty jeans. There, you look as handsome as your dad, if I say so myself." "I don't like it," Kyle muttered. "You won't have to wear it for long. At the rate you're growing, it won't fit anymore by Friday," Rick interjected. "Well, I think it looks good on you, and the jury will think so, too," Will said, "I don't care what a bunch of strangers think." "Those strangers," Will said, his patience wearing thin, "are the only thing keeping Dan from getting out and making your life hell. So, young man, you need to keep them on your side. Do you understand me?" "Yes," Kyle said, defeated. "Good," Will said. Will drove Kyle to the courthouse, while Rick took Charlie to school. They entered the courthouse and passed through the metal detectors, before heading to the District Attorney's office to check in. Kyle didn't talk to Ms. Marshall, who made it clear that she didn't want to give the impression she was coaching a witness. Rick met the pair in the courtroom. They sat up front behind the D.A.'s desk, with a clear view of the defendant's desk. Kyle felt his heart start to race. He hadn't seen Dan, since the day his mother had beaten the man with a bat. It seemed like a lifetime ago. After a few minutes, Dan was escorted into the courtroom by a deputy. He looked around the room until he spotted Kyle. Kyle also looked at his former lover, and was not expecting the look on the older man's face. Kyle thought that Dan would be angry; instead, Dan had the look villains in Rick's movies have. The look that said, "I can't wait to tear you apart." "Keep your eyes to yourself, freak!" Rick barked. "Rick!" Will quietly chided, as a deputy walked over to tell Rick off. "We're sorry, officer," Will offered. "Tell that piece of shit to stop staring at our kid. He's once the victims," Rick spat. The deputy nodded and went over to have a few words with Dan, who averted his gaze angrily. Will said in a near whisper, "Now is not the time to be angry. You need to keep yourself and your mouth under control, or you'll be removed from the courtroom." "What else am I supposed to do? Sit here while Dan tries to intimidate Kyle?" "Yes," Will said flatly. "Yes, you are supposed to remain calm and silent, no matter what Dan does. If you keep having outbursts, his lawyer will try to have the case thrown out due to a mistrial, claiming that the jury is too tainted to be impartial, which will start this whole process over again, provided it doesn't get thrown out entirely." Rick huffed, crossed his arms and pouted. Will, satisfied with Rick's non-verbal response, looked at Kyle and asked, "Are you okay?" "Yeah," Kyle muttered. "Okay," Will said, not believing a word of it. "Remember what we practiced?" "Yes," Kyle said, a little more confidently. "Look at the lawyers when they ask me questions, look at the jury when giving my answers, don't look at Dan, and don't talk to the judge unless the judge talks to me first." "And what if you get confused?" "Ask them to repeat themselves or ask them to rephrase their questions." "What else?" "Only answer yes or no, unless they ask me to clarify, especially Dan's lawyer." "Good, boy," Will said, hugging his son. "You're going to do great. What happens if you get too nervous or upset?" "Take my time to calm down, and don't let Dan's lawyer bully me into answering before I'm ready." "You should be a lawyer like your old man," Will teased. "All rise," the deputy called. Everyone stood, as the judge entered the courtroom. He ascended the bench and took his seat. Once settled, the judge told everyone to take their seats. He called the case to order and called the jury in. Once the jury took their seats in the gallery, the judge then addressed the assistant district attorney, "Ms. Marshall, I understand there's been a development with one of your witnesses?" "Yes, Your Honor." Ms. Marshall gave an update on Ry's condition and her plans to call him as a witness the next day. "Your Honor," Dan's attorney said, "How are we sure that Mr. Doernbecker is capable of giving an accurate account of events? We don't even know the extent of his injuries, let alone if he has any brain damage." "Ms. Marshall?" The judge indicated. "Your Honor, we just received a report from Mr. Doernbecker's attending physician, Dr. Emily Bower, who is also here." Kyle looked around and saw Dr. Bower sitting towards the back of the room. "Dr. Bower is prepared to testify that the only damage that is relevant to this trial is the witness's ability to talk clearly. With the Court's permission and patience, we can accommodate him via a telecall." The judge called Dr. Bower to testify. Both lawyers, especially Dan's, asked a lot of technical questions, but Dr. Bower was confident that Ry could testify, though his speech was still muddled. The judge seemed satisfied and made a note to make arrangements, so Ry wouldn't have to leave his hospital room. "Alright, Ms. Marshall, please call your next witness." "Yes, Your Honor," said the prosecutor. She called Kyle's name. The boy stood and approached the witness stand. He was asked if he swore to tell the truth, which he did. He was then asked to state his full name and date of birth, which he also did. "Kyle," Ms. Marshall started, "Would you please tell us, in your own words, what happened to you at the home of Mr. Clark on Labor Day of last year?" Kyle steeled himself. He explained how he and his family were over at Dan's for a neighborhood party Dan was throwing. Kyle had avoided Dan the entire time. He needed to use the restroom, but someone was already in there, so he used the one in Dan's room. When he was done, Dan was waiting for him. Dan was mad at Kyle for ignoring the older man, and when Kyle tried to leave, Dan grabbed him, threw him on the bed and managed to pull down his pants and underwear. Dan was in the process of pulling down his own pants, when Ry entered and attacked Dan. Soon after, the adults and police came. "How did you feel while all this was happening?" Ms. Marshall asked. "Scared." "Why were you scared?" "I thought he was going to rape me." Dan's lawyer said, "Objection. Speculation." The judge replied, "Overruled. Please continue." "Why would you think that?" Ms. Marshall pressed on. Kyle paused, then said, "Dan and I had had sex several times before, and he always wanted to have anal sex but I didn't want to." "And this made you think he wanted to rape you?" "Yes." "Were you aware that the defendant had recorded your past, sexual encounters?" "Yes." "When did you find out about the recordings?" "Your Honor," Ms. Marshall said, "Given the age of the witness and egregious nature of the evidence, I would like to present people's exhibit 12b in part. The State feels that we only need to show the witness a few seconds of the video to potentially identify those in it." "Objection your honor," Dan's attorney said. "As we understand and sympathize with the sensitive nature of the video, the State can't expect to submit the entirety of the video based on a few, hand-picked seconds of corroboration from the witness. The State either needs to play the video in whole or not admit the evidence at all." Will thought the request was unusual. It was a gamble to get the entire video thrown out, for sure, but allowing the video to play in full, would only prove to the jury that Dan was guilty of sexually abusing Kyle, regardless of the attempted rape. "Your Honor, the State feels that the video is inappropriate for the witness to view, but would be more than willing to show the full video to the jury, once the witness is done testifying," Ms. Marshall offered. "Madame Prosecutor, I'm going to sustain the objection," the judge said, "please show the video and continue with your examination." Ms. Marshall looked as confused as Will was, but she put the DVD into the player and started the video. Kyle recognized it as the first time he and Dan had sex. Will looked over at Dan and noticed that Dan was rubbing his crotch under the table. Dan was fully erect and a dark spot of pre-cum stained his light, gray pants. Will looked quickly at the jury. All of them had horrified looks on their faces, but three weren't looking at the video screen; they were looking at Dan and his groin. Gotcha, Will thought. Rick cried as he ran from his seat, over the barrier and towards the defendant's table. The deputy was quicker and tackled Rick. The judge banged his gavel and called for order. He instructed the jury to leave, and had Rick hauled out of the courtroom. Once everyone was settled, the judge called for a five minute recess. "What was he thinking?!" Ms. Marshall said scathingly. "He wasn't," Will said. "He could've ruined the case!" "Actually," Will said, "he might have just saved it." "What are you talking about?" "Do you have access to the courtroom cameras?" "The court clerk does, why?" "See if they can see under the defendant's table. If they do, look back to the time the video started and the time Rick overreacted." "What's this all about?" "Trust me. It'll be worth it, especially if you can get a clear look at the jury, as well." It was over 20 minutes before the courtroom opened up again. Will and Kyle took their seats. It was unclear whether or not A.D.A. Marshall watched the videos or not. The judge called everyone back into session, but this time, the jury was not called in. "Ms. Marshall, I understand that you and Mr. Clark have reached a deal?" The judge asked. "Yes, Your Honor. Given the circumstances that lead to the recess, Mr. Clark has agreed to take our offer of a plea deal." "What?" Kyle asked, shocked. "Shh," Will said, taking his son by the hand. "Mr. Clark," the judge said, addressing Dan. "I understand that you have fired your attorney and will be representing yourself for the rest of the proceedings?" "Yes, Your Honor," Dan said. He looked flat and defeated. The judge then said, "I would like to note that I do not recommend that you represent yourself, however, I cannot make you choose another lawyer to represent you. If you're still willing to continue, we most certainly can." "I understand, Your Honor, and I wish to continue representing myself." "Very well," the judge said. "Please bring in the jury." The jury was brought in. All of them avoided eye contact with Dan, which Will pointed out to Kyle was a very bad sign. "Members of the jury," the judge continued, "it has been brought to the Court's attention that a deal has been struck between the defendant and the State, so your services are no longer needed. The Court thanks you for your time and service. You are dismissed." The jury left the courtroom, many of them shooting withering looks at Dan. "Mr. Clark, please rise," asked the judge. "The Court understands that you are pleading guilty on all counts, except Count 84, which is the attempted rape charge, is that correct?" Dan looked like he had swallowed a frog, but he managed to say, "Yes, Your Honor." "Okay," the judge said. He then went down the list of charges one by one, including the multiple counts of sexually abusing Kyle and little Billy. Each one, Dan pled guilty to. Once the judge was done, he scheduled a hearing two months from then for Dan's sentencing, so that Dan could make legal arrangements. "What does this mean?" Kyle asked. "It means that it's almost over," Will said, triumphantly. "What about the rest of my testimony? Or Ry's?" "There's no more testifying, and Ry won't have to testify at all." "So, I'm done? It's over?" "Well, there's still sentencing. You will be asked if you want to say something about what Dan did to you and how you feel about what happened, but you don't have to, if you don't want to." It was about then that Debbie and Billy Dempsey came over. "You were so brave," Debbie said, hugging Kyle. "Thanks," Kyle said. "Hi, Billy." "Hi," the little boy said, avoiding eye contact. "I have a son named Billy," Will interjected, patting Kyle on the back. "Cool," the small boy said, shuffling his feet. Will looked at Debbie and said, "I guess this means your son won't have to testify." The young mother looked about to pass-out from relief. "I was dreading that moment." To Kyle, she added, "I completely understand what your dad did. I felt like attacking that piece of shit, myself." "Mommy, you said a bad word," Billy said. "I know, Baby, but the bad man upset Mommy." "Is the bad man going to get me again?" Will slid off of his seat to Billy's eye level. He gently lifted Billy's face till they made eye contact. "I swear to you, he won't hurt you or anyone ever again." Billy started to cry, and Will pulled the boy into his arms and held him. "Dad," Kyle said softly, putting a shaky hand on the man's shoulder. "We need to check on Dad." Debbie looked confused, then Kyle explained that he had two dads, and no, neither was gay. Will let Billy go, both wiping their tears away. "You're right. We need to make sure Rick isn't going to be staying in jail." After saying goodbye, father and son walked towards the exit. "Mr. Parker," Will heard from behind. He came to a halt, and both turned around to see Detective Dunham walking towards them. "Hello, Kyle," the detective said, "I'm glad things have ended for you." "How did you find out so fast?" Kyle asked, wondering if she had superpowers or something. "I was in the courtroom," she answered. "Anyway, Mr. Parker, I have some bad news for you regarding Ryland's siblings." "What is it Detective?" Will asked. "I'm afraid that both of Ry's sibling's have passed away." "Oh my," Will said, shocked at the revelation. "When? How?" "Ry's older sister, Bethany, died about nine years ago, when she was fourteen from a drug overdose. She had been in and out of the court system and foster homes for years prior." "And what of his brother?" "James died a few years later, at the age of 20 in prison. He was part of a gang before going in. According to his record, he had turned state's evidence against the gang after finding out they had supplied Bethany with the drugs she took and had been prostituting her since she was about twelve." "My God," Will said. "Ry's parents must have known." "According to our reports, the parents were notified immediately of both deaths." "And they never told Ry?" Kyle asked. "We don't know," the detective said. "I wish I had better news for you." "What about his aunt? I haven't found anything on her." "There are no records that either of Ry's parents had siblings, and the state has his grandparents' death certificates on file. As far as we can tell, Ry has no living relatives." "Thank you, Detective," Will said, before walking away with Kyle. "Does that mean Ry can be adopted?" Kyle asked. "Yes it does," Will said. Excited, Kyle said, "This has turned out to be a great day!" "I'm not sure Ry will feel the same way," Will said. "Oh," Kyle muttered. "I didn't even think about that." "Well, let's get your other dad, before someone makes him their bitch." "What?"
