Chapter 59 "I'm burning this once I get home," Kyle said, as he adjusted his tie. When he said he wanted to go to the sentencing, Kyle never thought he'd have to wear his suit again. "No, you're not," Will said, fixing Kyle's tie. "It cost too much for you to destroy it." Kyle huffed as his dad tightened the knot around his neck. He was nervous about appearing in court again, as the last time was bittersweet. At least it'll all finally be over, Kyle thought. He had been working on a victim impact speech, which Will had attempted to help him write. Deep down, Kyle had issues with the speech. Will wanted it to be as damning and impactful as possible. His dads wanted Kyle to condemn Dan for abusing and nearly raping him; however, Kyle didn't share their views. With the exception of their last encounter, Kyle knew he fully consented to everything he and Dan did, and Dan never pressured Kyle into doing anything that Kyle didn't want to do. It was true that Dan wanted to have anal sex, but he never overly pushed for it, even though Kyle was growing tired of saying no. In truth, Kyle didn't feel like a victim, and actually felt a little sorry for his former lover. "All rise," the deputy called. The same judge that presided over the trial was the same judge for the sentencing. He took his seat and asked everyone to do the same. Once he had announced the case and charges, he asked Ms. Marshall if she were ready. "Yes, Your Honor," the Assistant District Attorney said. As A.D.A. Marshall started her speech about Dan's crimes, Kyle looked about the courtroom. There were many faces he didn't recognize, but he did see Debbie sitting alone a few rows back. Her face was full of pain and sadness. Kyle never found out how she knew Dan before her son was abused by him, and Kyle wondered if she had dated the much older man, who then had access to her then toddler boy. Kyle looked over and saw Dan properly for the first time. He was wearing an orange jumpsuit that made him look much older and fatter than he was. Dan was shackled with his arms to his sides. Kyle wondered if this was to keep him from touching himself again. Once Ms. Marshall was done talking, the judge asked, "Are there any victims or relatives of victims present today who would like to address the Court before we commence sentencing?" Many hands raised in the air and a few voices called out in the affirmative. Will nudged Kyle, who raised his own hand, with some reluctance. "You don't have to do this," Rick whispered from Kyle's right. "I know," Kyle said, tired of repeating himself, "but I want to." The judge asked everyone to form a line behind a lectern that was set-up between Ms. Marshall's and Dan's tables. One-by-one, people approached the lectern. Kyle noticed that, not only was he the only child in the line, Debbie was still sitting down, tears silently falling into her lap. Parent after parent talked about the impact Dan's actions had on their children, many of whom were in therapy. Mothers cried while fathers raged. Some had to move towns or to other states to feel like they were safe enough from the man who hurt their children. One child, a boy of 10, had recently taken his own life, fearing that justice wouldn't be served and Dan would come for him again. It was finally Kyle's turn at the podium. He was too short to properly reach the microphone at the podium, so a deputy had to bring him a stool to stand on. The embarrassment didn't help with his nerves. He had never spoken to a crowd before. Even at the trial, he was able to focus on Ms. Marshall, while answering questions. This was very different from then. Kyle pulled the cards Will had prepared from his pocket. He looked down at them, and everything quickly blurred. Tears filled his eyes, and he felt the pain of Dan's other victims pour through him. "My name is Kyle Wells," Kyle started. "I'm one of the victims of Dan Clark." Kyle took a steadying breath and put away the index cards. "I believe I was his last victim, and now know there were dozens before me. I was born Billy Parker, and my mom changed my name after my grandfather molested me. I didn't know that until after my mom was arrested for attacking Dan. He was under house arrest for trying to rape me, but was outside in his underwear to get my attention, as if he was mocking me for turning him in. "I'm not the only Billy Dan hurt. He also hurt a friend of mine, who was two at the time. Billy is now six, in the same class as my little brother. It's Billy that should be here telling you what Dan did to him, but Billy can't tell you. Dan hurt him so bad that he can't even talk about it, not even to someone else Dan hurt. I know this, because I've tried. "Dan didn't just hurt Billy. He hurt Debbie, Billy's mom." Kyle turned and pointed to Debbie, who was sobbing in the arms of a woman seated next to her. "Debbie should be here telling you how much Dan hurt her son, but she can't because of the pain he caused her, too. "Dan would tell you that I was willing and wanting to have sex with him," Kyle said, steadying himself for what he was about to say next. "And he would be telling you the truth. He didn't force me to do any of the things we did; however, he didn't want to stop when I wanted to. I know that, because of the plea deal, Dan won't be charged with trying to rape me, but that doesn't change the fact that he did try, and if it wasn't for my boyfriend, Dan would've raped me, probably would've gotten away with it, it probably would've continued for years, and he probably would've continued raping and molesting other children. "We all know that Dan only took this to trial so he could watch himself, one last time, sexually abusing me and other boys. He only took this deal because one of my fathers saw him playing with himself and spoke out about it. My dad even got in trouble by you, Your Honor, for it. And if that isn't proof enough that Dan needs to go to prison for a long time, then I don't know why you even fucking bothered asking us to talk about what he did?" Kyle finished bitterly. The judge was too shocked to even bang his gavel. Kyle's legs were wobbly as he stepped off the stool. The man behind him caught Kyle and helped the trembling boy back to his fathers. A few of the adults in line took their seats, while the remaining people were emboldened by Kyle's words. Mothers and fathers alike angrily told the judge what Dan had done to their boys and a few told Dan that they couldn't wait for him to die. Kyle's fathers held his hands, while Rick wrapped an arm around his son's shoulders. Kyle cried and didn't bother to hide it. He wasn't sure if he should've said everything he did, but he was sure that Billy needed someone to stand up for him, like his own father had tried to do ten years before. After the last parent talked, the judge asked Dan if there was anything he'd like to say before the judge handed down the sentencing. Dan stood and said, "I'm sorry for the abuse these children suffered. They never should've been put in those situations. These boys were allowed to be put in bad situations by their parents; situations that no child should ever have to face." And with that, Dan stopped speaking. "What the fuck?" Rick muttered, as a chorus of anguish and fury echoed throughout the chamber. It took the judge several minutes to quiet everyone down, even after threats of holding people in contempt. The judge sternly said, "I'm moving onto the sentencing phase now, unless the State objects?" "No objections here, Your Honor," Ms. Marshall said, allowing her own disgust to be heard. After reading off each charge again, affirming that Dan had already plead guilty to those charges, and what the maximum sentence for each count was, the judge said, "Mr. Clark, I've had many sex offenders before me, and you stand out as one of the most repugnant I've ever had the displeasure of seeing. As each of those impacted by your actions spoke, you showed no remorse. Even when one of your victims spoke about what you did, you showed no hint of empathy or sympathy for what you put him or others through. And what's more, when given an opportunity to demonstrate before this court how bad you feel about what you did to all those poor boys, you not only avoided responsibility and personal accountability, you blamed the victims' parents! A boy killed himself because of what you did to him, and you don't seem to care in the slightest! "Look at everyone here, Mr. Clark," the judge ordered. Dan hesitated before looking at the assembled masses. "I want you to remember every single one of their faces every time you close your eyes, while you sit in your prison cell," the judge thundered. "So, it's with great pleasure that I sentence you to six years on each count to be run consecutively, for a total of 120 years. You will not be eligible for parole or any form of early release. Furthermore, due to your violation of your house arrest order, I'm also denying you time served." "I object to the sentence, Your Honor," Dan said, through gritted teeth. "Sustained," the judge snapped, "you can take it up on appeal. "Mr. Clark, I remand you to the custody of the Department of Corrections where your sentence shall begin. Deputy, get him out of my sight." The gallery erupted in cheers as the deputy removed Dan from the courtroom. The judge banged his gavel once more, bringing the room to silence. "The Court would like to thank each and every one of you for coming here today and sharing your stories. I know it wasn't easy for any of you, but be sure that your statements did have an impact on the sentencing. The Court is aware that the defendant's sentence won't change what happened, but hopefully, it will start the healing process for all of you." With that, the judge closed the proceedings. Kyle and his dads walked out of the courtroom and were stopped by Debbie, who was still crying. "Thank you so much for what you said," Debbie said, hugging Kyle tightly. "I didn't have it in me to say anything for Billy, and I'm so happy that you did it for me. You have no idea how much that means to us." "It's okay," Kyle said, awkwardly. "I'm glad I was able to do it." On the way home, Will asked, teasingly "So decided my speech wasn't good enough?" "It's not that," Kyle said. "It didn't feel right, so I went with how I felt." "Well," Rick said. "I think you did a great job. We're very proud of you." "Indeed," Will said. "I think this calls for a celebration." Fathers and son picked up pizza and headed home. As the three walked into the house, Kyle saw Charlie beating Terry at the latest fighting game. The large man was very competitive, and he didn't take being beaten by a six-year-old lightly, while Charlie made a point to laugh at and taunt the adult whenever possible. Lydia was reading a book, trying to keep her husband calm. Terry and Lydia congratulated Kyle for his bravery and speech. They all ate pizza and had a great time. Around five that evening, they visited Ry and gave him the good news and some of the pizza. Ry was proud of Kyle and blushed when Kyle mentioned the part about his boyfriend. Ry mentioned that Mrs. Grimble had been by to see him. Rick tensed up, as Ry recalled what was said. Apparently, Mrs. Grimble wanted to know if Rick had ever hurt him, and how his parents had known Dan, and whether Ry had ever been to Dan's while staying with Kyle. Ry told her the truth. His parents, like everyone one else in the neighborhood, had gotten an invite, that Ry never talked to Dan until the day he beat the man up, and that Rick had never done anything except make him feel cared for and loved. "I'll have Rebecca call her tomorrow," Will said. "We'll make sure that she doesn't ever talk to you again without a lawyer present." "I can't believe she did this," Rick said, bitterly. "Well," Will said, "You did provoke her, so how about you just leave this up to the lawyers." Rick grudgingly accepted Will's logic. Will went home before everyone else. He said he had some business to attend to before bed. He lived in a small, unkempt apartment downtown. He printed off a legal motion and signed it. Will knew that this was the last step he needed to get everything Dan ever cherished. The summary judgment was going to be filed the next day, and by the time Dan would be able to respond, it would be too late. Will poured himself a glass of red wine and took a seat at his desk. He logged into his VPN and opened his encrypted email. Will paused to contemplate his wording before drafting his missive. "It will happen in 60-days time. Accidents happen.
