Chapter 30 (TOM'S POINT OF VIEW) I heard a lot of yelling upstairs than it got quiet. than all of a sudden the yelling started up again. I knew one of the voices going back and forth was David's and the other one was Jake's. The third could only be David's father. I met the man once, and I don't care to meet him again. Then all of a sudden I heard screaming and I knew the screams were David's. I started to run upstairs as the screaming turned into crying. As I reached the top of the staircase, I saw Jake's brother Jeremy go running by me. Soon after that, Jake went running by me with Andy on his tail. I had no idea what in the world was going right now. As I turned the corner, I saw David in a ball in the corner. His dad was grabbing at him and Joey was trying to get David's dad away from him. I just ran up and tossed David's dad to the ground and covered up David. I wanted and needed to protect David. As I wrapped my hands around David, he was shaking so bad. David was still screaming out mumbles I couldn't understand. I held him even tighter to comfort him the best I could. Finally David wrapped his arms around me and just hid into my chest. I didn't pay any attention to what was going on around us at that moment. The only thing that was going through my mind right now was protecting David. That was all, so I didn't care what his dad was yelling about. I whispered in David's ear: "Don't worry my teddy, I am here and nothing will ever hurt you again. I promise you that!" I picked up David and walked upstairs to his room carrying him. His dad once again tried to grab at him, but I pushed him out of the way. Doesn't his dad know the last thing you want to do in the case of his son is grab at him. For God's sake, the poor guy was dragged into a warehouse kicking and screaming for his life. It went so bad he ripped off several of his fingernails. I really don't think David will ever get over this in his lifetime. How do you get over a brutal rape? (JOEY'S'S POINT OF VIEW) When I saw Tom come running over and protecting David, I was relieved. At this point the only one that could settle David down was either Tom or Jacob. Jacob was running to catch his brother, leaving Tom to take care of business here. When Tom picked up David and went upstairs I felt one fire was put out. Now I need to find a way to get David's dad out of the house without David. "Sir, with all due respect, as you can see David still has a lot of demons. We were told not to grab at him or show any kind of force because he might go back to that night. When you went to grab at him, I am pretty sure he flashed back to the worst night in his life. Nothing you did, just the memory of that night was all." "I know that and that is why I want him to come home with me. This isn't the best place for him right now. He needs to be surrounded by his family to get him through this!" "Again with all due respect Your Honor, we are his family right now. Didn't you see that no matter what you did, he wasn't calming down? But the minute Tom showed up and held him tight, he calmed down? We are not trying to replace you guys, but it was better he was around those he trusts and he knows he can lean on right now!" "Those two really do love each other don't they?" Tears started to roll down David's dad's face. I have never seen this guy show any weak emotion. "I never thought in my wilds dreams that anyone in my family, my kids more so, would go through the hell David went through!" Once again David's dad wiped the tears from his face. "This isn't your fault or ours either. It was the fault of the five that raped him that night. Jacob is doing everything he can to get those that did this to justice. Jake can't rest until that happens. This is his family in this house and he loves each of us as though we are his own." "I can see that Joey. Jake is turning into a good man. He had to go through so much early on in his life, but he got stronger through it all. Now he wants to protect all those that mean the world to him. I feel so good that my son is among those." "I just want to be a father and protect my son like any good father should do. But at the same time I hear what you are saying. David feels safer here than he will feel anywhere else. Tell Jake I will speak with him before I go back to Austin. Tell him how much I appreciate everything he has and is doing for my son." "I will make sure to pass the message along to him." "I know it was best that I don't go up there and say goodbye to my son right now. Please tell David I am very sorry for my behavior and I love him with all my heart. I wish I could take this pain away from him, I would do anything to take away his pain!" "I will make sure David gets the message as well. Please be careful and come back and speak with Jake before you leave." I shook hands with David's dad as I walked him to the door. He walked out and headed to his car. I watched him as he drove away. I went back into the den and just sat down in the chair. I was now getting worried about Jacob, Andy and Jeremy. They are still not back and it has been over thirty minutes since Jeremy ran out the door. There was no one to blame for this. Jeremy was in a new place, and not even a week had passed by yet and something like this happens. Poor Jeremy I feel for him. I could only imagine what was going through his mind. (JACOB'S POINT OF VIEW) I was trying my best to settle David's dad down. He is so angry I can't believe it. Well, I can believe it because this is his son we are talking about here. He left his son in my and Beth's care and look what happened. I'm not trying to make excuses for what happened. I do believe if it were going to happen, it would have no matter if David were with us or back home with his family. Once again no one deserves what has happened to David. I wish I could turn back the clock and change what has happened, but I can't. Then it happened; David's dad went to grab his son, and that was it. We were told to be very careful with touching David. It is because of the emotional damage David suffered from being dragged into the building and raped on the worst night of all of our lives! As David's dad got hold of him by the shirt, David totally lost it. He started screaming in fear. It was a screeching scream that showed us how scared David still was about what happened to him. David some how got loose and hid in the corner. As I was about to walk up to him, I saw in the corner of my eye, my brother Jeremy running down the stairs and out the door. I turned to Joey and looked at him. "Make sure David's dad leaves but not with David." All Joey did was shake his head to the positive and I took off. Running after Jeremy was my brother Andy and Chase. We needed to get to Jeremy before he got to Mesa Street! That street was the main street down the west side of town and the traffic was ugly. Man, can Jeremy run, because we had no chance to catch up with him. He crossed Mesa without a care in the world. Cars were coming to a complete stop trying to avoid hitting him. I am surprised there wasn't an accident. Andy, Chase and I crossed the street as carefully as we could. By the time we reached the other side, I had lost track of Jeremy. I looked over at Chase and Andy with a worried look on my face. "Let's split up and look for him. Remember if you find him; don't try to force him to come home. It will make it worse. If you feel you can't get him to go with you. Call for whoever isn't around. In fact once whoever finds him, call out for the others!" I went straight, Chase went left, and Andy went right. I can only hope to find Jeremy and hope he isn't too freaked out. I looked down each street as I passed them. I finally saw what looked like a neighborhood park ahead of me. As I walked to the park, I saw a figure swinging on the swing set. I couldn't see the figure that clearly. So I walked up as slowly as I could in order not to scare whoever was on the swing. About five feet away I was able to make out that it was Jeremy on the swing. I breathed a sigh of relief when I saw him there. "Jeremy it's Jake, are you ok?" Jeremy didn't look my direction, but he didn't act as if he was going to run either. I walked up to him and sat on the swing next to him. I started to swing along side of him. I stayed as quiet as possible until he noticed I was there. He looked at me and smiled like we had planned this trip to the park. We sat there swinging for about ten minutes. I noticed Jeremy was getting tired as he stopped swinging. I got off of the swing and waited for Jeremy to do the same. Once Jeremy's swing stopped, he got off and walked up to me. Poor guy, he looked very tired and confused at the same time. I held onto him as we walked back towards the house. I wanted to yell out for Chase and Andy, but I knew if I did it was going to spook Jeremy once again. There was no need to, because once we arrived at the street corner, they were there waiting for me. I joined them with Jeremy and we walked back to the house. The minute we got in the house, Jeremy went to the kitchen. I knew what he wanted so I followed suit. He already had his glass and was about to poor a cup of milk. I went over to the pill dispenser and got Jeremy's evening pills. He took them as he headed to bed. I went with him to make sure he was fine and in bed. I made sure he was changed into his pajamas and in bed before I turned off the main lights of the room. I always leave the light on in his closet and several night-lights leading to the bathroom for him. I walked down the hall to David's room and peeked in. The light was still on, but Tom and David were asleep already. Tom has his arms wrapped around David and holding him tight. David's head was buried into Tom's chest. Those two must have fallen asleep as soon as they got up here, because they didn't even change clothes. I went back downstairs to check on the other guys. Chase and Andy were sitting there watching television. At first I didn't see Joey. As I was leaving the room, Joey called out for me. "Hey babe where are you off to?" "I was searching for you. So I figure nowhere since I just found you!" "Well you really didn't find me, I found you!" As I was sitting down next to Joey, I started laughing at what he had said. He was kind of right on that point. We sat there for a couple hours watching movies. No one said a word about what happened this evening. I got up and called it a night and headed up. As I passed Jeremy's room I popped my head in again. Jeremy was sound asleep! Once I felt comfortable with Jeremy, I closed the door and headed to my room. I tossed my clothes to the floor and crawled into bed stark naked as always. The minute my head hit the pillow, I was out. I figure the run I had earlier in the evening did me in. Jeremy hitting my shoulder awakened me. I looked up at him and he was smiling. I crawled out of the bed keeping the sheet wrapped around me. I went into the bathroom to put on a pair off running paints and a t-shirt. It is cool to sleep with out a shirt, but it isn't cool to run around the house with out one. While I was taking my meds, I gave Jeremy's his. He did everything I did in the same sequence. It didn't bother me; in fact I thought it was cool. As I was brushing my teeth I heard loud banging coming from downstairs. At first I couldn't make it out! Then I heard Beth calling for me. The words that were said next brought chills up and down my metal spine as Beth were saying them! "Jacob your mother is here to see you!" I turned to Jeremy and signed to him to stay here in the room. `Please don't go anywhere until I come back for you'. I walked downstairs to the den where my mother was standing. I looked at her and I knew she was not happy once again! "Jake were you ever going to call me and let me know three days into having Jeremy here, he already ran away from you?" "Well good morning to you to mom! I am doing fine and you? Yeah the trip went well and we are all safe and sound! These maybe the normal opening statements one would say to another instead of yelling about the bad things that have happened!" "Jake I really don't care about the trip, the weather, or giving you every count of my health. You can't handle Jeremy and you know it. Again, were you ever going to call me and let me know about the issues that occurred here last night!" "No I was not mom! The day you walk in this house and pay for the bills and really buy this house from me, that is the day you can order me to report to you. Until than, what happens in this house is really none of your business! Who in the world even told you about what happened here last night?" "Andy called your sister Marie worried about Jeremy who had just ran out of your house. He ran out because of your gay friends screaming like a little girl." "I will be talking to Andy about this. You said one thing when we were growing up. What happens in the house stays in the house. That goes here as well." My mom just stood there and tried to stare me down. As I was looking at her waiting for some kind of reply, Joey walked in. My moms face turned even redder than it already was. I was afraid she might explode with hate. "What in the hell is this fag- I mean Joey doing here? This is a family matter!" "Well Ms. Hernandez I am Jacobs boyfriend, like it or not. So I am his family as much as you are. Plus I helped buy this house and I am getting tired of you coming over here yelling about everything going wrong. If you truly loved Jacob, you would let him live in peace and stop yelling at him for everything little thing." "Until that day comes Ms. Hernandez you are no longer welcome in this house. I believe Jacob told you that once before. I am telling you now. Please, until you can see fit to treat Jacob and all of us with respect, don't come around!" My mom just stood there stunned at what just transpired. I was as well! What did Joey eat before he went to bed last night to grow some balls? I loved him even more that moment when he finally stood up to my mom! My mom was looking at me for support, and when she saw she wasn't going to get any, she left. As the front door shut behind her, I leaned in and kissed Joey. That was all that needed to be said. I went up and grabbed Jeremy for breakfast. As soon as everyone sat down and started to eat, I said my peace. "Look guys I am saying to everyone where I don't have to repeat myself over and over again to each of you. Whatever happens in this house will be handled with this family. We are all family for whatever reason or another that brought us together. We will lean on one another when that is needed. We will pick each other up when that is needed. We will always be here for one another." "One thing we will not do is go running out and involving outside sources or people in our business no matter how dyer you feel it needs to be done. If we do that, we show we can't handle ourselves living here." If any of you can't follow this creed, there is the front door. I will miss you so much, but I need to be able to depend on you that we will talk to each other. Please, I love each and every single one of you at this table. Just respect everyone and everything in this house, and that is all!" I looked around the table, as I was finishing up. Everyone was clinging onto every word I was saying and by the looks in their moist eyes, they understood. As soon as I finished eating Andy pulled me in the study. He looked at me with a look a sorrow. I got through to the one that really did wrong. "Hey bro you know I didn't mean to cause you any problems with mom this morning! I didn't talk to her I talked to Marie. I was worried about Jeremy at the time!" "Andy, you know as well as I do, Marie will go running to mom and tell her whatever she finds out. Remember how it was living in that house of mom's. We all went running to her when ever we get a bit of information to tell her." "I know Jake and I am sorry! It will not happen in the future I promise!" "We are cool Andy don't worry about it. Plus it isn't really Marie's fault either so don't be mad at her. We just have to stick together on things; that's all. I am starting to get a feeling mom wants to destroy what I have here. I will not allow it!" The rest of the day went off with no more problems. I was happy about that! Andy took off to spend the evening with Norma, his girlfriend. The rest of the guys and I were in the game room playing one game or another. Even Jeremy was getting into the video games. I don't think he understood the concept, but he really liked the bright colors and noises. Everyone settled down in the game room. We just sat wherever there was room on the floor. Joey of course was sitting next to me and Jeremy. Tom and David were together. Actually Chase's girlfriend came over and decided to hang with us. Chase seems to be the one to get things going and tonight was no exception. "Jake you need to tell us something you never told us before. I don't understand the makeup of your family. We all met your mother, and there is no way you take after her. So that means you take after your father. But once again none of us have met the guy. What is up with that? Is he dead or alive if I can put it bluntly?" "Wow Chase you cut right to the `chase', don't you?" We all laughed as I wondered how much to tell the guys. I really don't want to bore them or you but I really have not told anyone what happened to my dad. "Where do I start? I figure the easiest place to start is yes as far as I know my dad is alive. In fact I do have a picture of him when he just married my mother." I pulled out my wallet and took the picture out. I passed it around to the guys. "If you didn't tell me this was your father, I would have assumed it was you and Jeremy. You two are the spitting image of your dad. What the hell is up with that?" Chase mumbled as he passed the picture to David. "Yeah I have been told that several times that Jeremy and I are a spitting image of my father. Anyways this is what has been told to me by family members or pieced together by what has been whispered over the years. Now how much is true or how much was said out of anger, I don't know." "My father, of course, married my mother and moved her to Utah. Jeremy was born first right after my father quit the Army. My mom just quit the military as well but was going to school at night and working civil service during the day. Anyway one day my mom got home to find the music loud, the house smelling like weed, and Jeremy crying. When she walked into his room, she found my father all-high on weed yelling and hitting Jeremy. My mother grabbed Jeremy from my father and left the house. "She moved back to Wyoming, but my grandfather told her she was married and she had to go back to him. At first she wasn't going to no matter what anyone told her. Then she found out she was pregnant with Andy. She felt defeated and went back to my father." "It didn't last much longer after she had Andy. Once again she found out when the babysitter left, he was beating on Jeremy. Plus he wouldn't stop the weed. So she got tired of it and headed back home again. This time she was set on not returning to my father no matter what." "A couple of months later she found out once again she was pregnant, and it was me. She told the family about it and made it clear she was not going to back to my father. My grandfather kept pushing her to go back until one fateful Friday night." "My mom and her best friend headed out for a night of dancing. Since Cheyenne really didn't have nightclubs at the time, they had to go out of town to Greely. She always used this old freeway between Cheyenne and Greely! It was a two-lane freeway. "On their way home, my father was following them and actually drove my mother off the road flipping the car once and left. No one was hurt, unless you count this ugly mug sitting here in front of you guys here today!" Everyone started laughing. I thought the mood was getting a little to down so I needed to lighten it up some. "That sealed the fate of my father with my mom's family. No matter what happened after that, no one pushed her to go back to my father. She never did and till the day I left the house, she never took one red cent from anyone." "Wow, is all that comes to mind Jake, wow! You never had a chance to meet your father?" "Not really David, as far as I can recall. I was told my father saw me one time when I was three. My mom decided to give him a chance to be with his boys. But when he arrived at the house drunk dropping us off, that was it for him!" "Now I am confused here Jake! Your mom left your father before she even knew she was pregnant with you. At one time or another she went back to your father to have your sister Marie." "You fool! Haven't you noticed she has a different last name than us? She has a different father!" I laughed at what Chase said. "I never knew that Marie had a different last name, so excuse me!" Chase got up and slugged me and sat back down. "Enough with the somber moments we are having right now. The soap of `In the Days of The Hernandez Family', will be continued another day!" We all laughed at that and started playing pool in teams. This time because the way Chase and his girlfriend play, I put in the actual rules of the game. You know call your pocket, the ball you are going to hit and when you can't hit the other team's ball or the eight ball to sink in your ball. We played till eleven and I realized I needed to get Jeremy his medicine and get him to bed. I had to get my ass into bed as well. I already missed a week of school. I can't give any more excuses for my mom to say I can't take care of myself. As the week started it was the beginning of a new six weeks for me. Actually, the start of the new six weeks started last week when I was gone. So I had a lot of catching up to do as far as homework was concerned. Monday morning the Coach of the track team wanted to speak with me. At first I didn't know why, but by the time I got to his office I pretty much had the scoop from the other team members. He was upset I missed a week of practice and just showed up for the meet on Saturday morning. I knocked on the Coach's office door and he called me in. Just from the sound of his voice I knew he wasn't in a good mood. Not even looking up at me, the coach told me to take a seat. I did and waited for him to say something. "Jake right now I don't know what to do with you. You missed all last week and then walked on the track on Saturday morning wanting to run. I should have sent you home. No one is allowed to miss an entire week of practice and then come in and run in the meet." "I need to do something with you, what, I don't know. Explain to me what to do! Give me a good enough reason not to suspend you from the team!" "Coach, I told you I was going to be gone. You didn't say a thing about that when I told you beforehand. I said no matter what I was going to run last Saturday and I did. You didn't have a problem with that at that point. Now you seem to have an issue with me missing practice after I explained everything to you." "I don't need to give you a good reason not to suspend me from the team. You need to find out yourself what you want. I did everything I could to keep you aware of what was going on. And let me make this clear sir, my family comes first." The coach just sat there and he knew I was right on this. What a hypocrite he is being right now. I am sure there were complaints from the other team members and he doesn't tell them it is none of their business what is going on. I cleared everything with him and now he is being hard ass about it. "Jake you did clear everything with me. I agree with you that family does come first and you need to take care of that family. I have talked to you and we are on the same page. Now if anyone asks you what happened here just tell them it is none of their business." "Yes sir and thank you!" I got up and walked out thinking to myself he needs to take is own advice. There was no reason to call me in and go over what we had already spoken about. Why in the world does this kind of stuff follow me? I must have the worst luck a person can have. Between homework, track, and JROTC my first days went by fast. The days started out early and ended late. When I got home there was Jeremy waiting for me the minute I walked in the door. I really enjoy Jeremy being around. One thing about him is his energy just flows to everyone around him. As we started the week, there were a few bugs to be worked out. Poor Beth had to take care of Jeremy for the first two days. Some how the company I hired as care taker for Jeremy got the schedule confused. How in the world that happened could not be explained to me fully when I asked! Simply put, the person that is assigned to Jeremy visited us the week prior. So there was no excuse for this and I really let them know my anger in this matter. Finally by Wednesday everything started to slow down for me. I caught up in my classes and my fellow team members seem to have forgotten the beef they had with me not going to practice last week. As I walked in the door, Beth greeted me. At first I didn't understand why, but when I walked in the den, I knew. Mr. Anderson was sitting there drinking a soda. I looked over at Beth and she had a confused look on her face. "Hello there Mr. Anderson, how are you doing today?" "I am doing well Jake and how about you?" "Doing well, more than I can ask!" "Good Jake and I am sorry for just popping up on you like this. I needed to speak with either you or Beth here about her husband!" "Why don't we go to the study? Within a few minutes the guys will be coming home and making a lot of noise as they walk in." "I have no problem with that Jake!" We headed to the study. On the way I got Jeremy to come in with me. I didn't want to leave him alone unattended. I surely didn't want another night like we had last weekend. I introduced Mr. Anderson to Jeremy as we were taking a seat. "I spoke with the district attorney over in Scottsdale Arizona. Most of the investigation has been done already. They don't need your husband's body anymore, Beth. Since you are still married to him, they need to release the body to you!" "Mr. Anderson I really don't know what to do with his body. Why don't you speak with his sister or bother here in town. They might want to take care of all that." "I did do that and they simply don't want a thing to do with him. He burnt so many bridges when he was alive. Even in death, no one wants to deal with him. I know right now your children have bad feelings towards their dad. But you don't want them one day thinking why you didn't do what you could do to bury him properly!" Beth just looked to the ground and didn't say a word. I looked at her and realized that she wasn't going to make any decisions on this matter. I really don't blame her because of what she went through. "Mr. Anderson let's do this. The cost to bring the body out here will be high. I believe that is why his bother and sister don't want to have a thing to do with him. So let's have the local corners office arrange with a local funeral home to cremate the body and send it up here." "Once it arrives we will take care of the funeral arrangements. It won't be anything big, but it will give a chance for the family and friends to say goodbye properly to him. I want my boyfriend to do that so he can let his demons go." "Ok Jake I see no problem with that at all." "Please Mr. Anderson send me the bills to get this done. I don't want my boyfriend's dad buried in an unmarked grave. Joey would never forgive himself for that." "You've got it Jacob. I will take care of it all. You will probably not hear from me again about this issue. I will pass the message to the local corners office and they will contact you Jake. You should think about getting one those new phones where people could get ahold of you when you are out of the house." "There is no way the school will allow me to keep it on. It would be a waste of money. Beth here let's me know the minute I walk in if anyone called me." "It was just an idea, nothing more!" Mr. Anderson turned to Jeremy as he got up to leave. "Nice to have met you Jeremy!" We all shook hands as I walked him to the door. As I shut the door, the guys were restless and hungry. Beth went in to the kitchen and finished up dinner. As she was doing that, I took Joey to the side. I explained to him why Mr. Anderson was here and what was decided. At first Joey just looked at me. Then he just walked over to me and hugged me whispering in my ear. "Thank you so much babe for doing this for us. I really need to say goodbye to my dad. I know he was a son-of-a-bitch when he was alive, but he was my dad!" Joey let go and wiped his eyes. Beth called out that dinner was ready. The rest of the evening was peaceful. I liked my evenings that way. Joey and I went to bed earlier than normal. I was actually beat and fell asleep by eight. By Friday I already received the call from the funeral home in Phoenix concerning Joey's dad's body. I called him back and told him the wishes of the family. I gave the payment over the phone for the cremation and the shipping of the ashes. I knew Joey's mom was not up to doing anything with the funeral of the man she once loved. So as soon as I finished up the call with the corner in Scottsdale. I called and arranged a very small funeral for Joey's dad on Sunday. It wasn't anything big and that is why the service was accepted on such a short notice. Mid afternoon the family and friends that want to come and pay their respects can do so. There won't be a body for anyone to view. Afterward there will be a small dinner and that will be it. As far as the ashes, I bought a small plot and gravestone where Joey's dad could be placed to rest. (TOM'S POINT OF VIEW) I want to do something for David. He's had it hard in the last couple of weeks. I will not push him to have sex. I know it will be awhile, before we actually have sex. He just started kissing me yesterday. Still I want to take him out and get him to remember the great things of life rather than the horrible nightmare he just went through. When I got home I asked Jake what he thought I should do. "Well you need to be very careful with David right now. Maybe you should keep him with the group. I know you want alone time, but it might freak him out!" "I want him to get used to being with me again and not be afraid!" "Tom he isn't afraid of you. Look at what happened when his father grabbed at him. He wouldn't settle down until you held him. He only trusts a few people right now and you are one of them. Don't push him too quickly." "If you really want to take him out, don't take him anywhere dark. That means the movies are out of the question. Take him out to a special place you and he both consider special. I recommend an eating joint. Read how he is taking it being out while you eat. If you see he is doing ok then take him to the mall or something like that." "Just don't take him somewhere dark and alone. He needs to be in places where there are a lot of people. That is the only way he will feel safe other than here at the house." "You are right Jake and I will do that. I will take baby steps on everything with David!" "I know you are frustrated and angry, but don't show that. He needs our support and needs our love. Please don't give up on him right now Tom.
