Chapter 50 Will walked into Ry's room and saw it was empty, not even Kyle's cot was there. He went to the nurse's station and asked where Ry was. The nurse looked him up in the database and said he had moved to a room on the seventh floor. Will went to the seventh floor and found Ry's room. Inside were Rick and the boys. Ry was no longer on the ventilator. His eyes were open and seemed alert, though he didn't move or speak. Charlie was given the other bed in the room. After the initial shock of seeing Ry, Charlie calmed down. His bed was moved against Ry's, so they could snuggle without putting pressure on Ry's body. Charlie was assigned a child psychologist named Nick, who thought it was a good idea to put both boys together. The room was also designed with a bench under the window that acted like a small bed, which Kyle claimed as his. "How did court go?" Rick asked Will. "Fine," Will said a little dismissively. "How's Ry doing? I thought they were going to wait till I got back?" "Ry woke up on his own," Rick said proudly. "He's a fighter." "Good, because he may need his strength." "What happened?" "The short answer is that Ry was supposed to testify in a couple of days, and it's uncertain if it can be pushed back. Dan's lawyer will push for the trial to move forward, and it's unlikely Ms. Marshall will get a continuance. It'll all come down to Ry." Rick nodded. "Oh, here," Will said, handing Rick a packet. "Here's the order. You are now Ry's temporary guardian for the next 30 days." "You hear that, Ry?" Kyle said, gently squeezing Ry's hand. "We're brothers." "Not quite," Will said, and explained the order and that once a relative of Ry's was found, they could take him. Rick admonished Will for his lack of tact. Tears ran down Ry's face. Kyle cleaned Ry's face and assured him that everything was going to be okay. Dr. Michaels, Ry's doctor, entered the room. She was much nicer than Dr. Bower. "I'm Will Parker, Ry's lawyer and Kyle's other father. How's he doing?" "Ry's recovering remarkably well given the extent of his injuries when he came in. "I'm sorry," Dr. Michaels said, "I thought your husband updated you." "We're not married," Rick and Will said. "Rick's is my ex-wife's ex-husband," Will clarified. Dr. Michaels told Will that Ry had been immobilized to make sure that he didn't stress the fractures in his back any further. He had shown signs of limited sensation in his legs, which might be from a slipped disk in his spine, but she couldn't be sure until his vertebrae heal a bit more. She'd test his speech and more of his cognitive functions the following day. She wanted to give his throat a chance to recover from a ventilator. "So far, he's responding to verbal cues, his hearing and vision seem okay, and he's able to move both eyes and blink, which is how we're communicating, which are great starts given what he's been through." Charlie refused to leave Ry's side and almost had another meltdown. Will updated Rick fully on Dan's trial. "I'm confused," Rick said. "About which part?" Will asked. "The civil suit." "Well, it's pretty simple, actually. When you told me that Dan was selling his house, I contacted a few friends of mine. I found out that he owned five properties, all houses, and four of them are rentals. He was selling them very cheap; just under one-hundred thousand each. I liquidated some assets, mostly stocks, and contacted the real estate agent. I made an offer on all five, she was authorized to approve the deal. Once everything was signed, the money was placed in an escrow account. Once the deeds were in my name, I had a friend file some paperwork freezing all of Dan's accounts and the account that had the money from the sale. I then served Dan the civil suit today. It's all pretty simple." "But, why bother with that? I'm sure they'll give Kyle restitution." "The District Attorney has to file a motion for restitution and damages have to be proven, and the kind of damage our son went through isn't covered. Usually, restitution is given when there has been a tangible loss, like property or medical bills from physical harm. Kyle never even saw a counselor, so there would be no damages to claim. "However, the civil suit is predicated on the fact that Dan is guilty. If he's found guilty by the jury, we get to use the evidence plus some from the criminal trial. It's what happened with O.J. Simpson, except O.J. wasn't found guilty in criminal court but was found guilty in civil court. The upside to doing it this way is that Dan can no longer take a plea bargain. If he does, he has to admit his guilt, which means he automatically loses the civil case and can only argue over the amount we're seeking." "How much is that?" Kyle asked. "Everything," Will said plainly. "What do you mean, 'Everything'?" Rick then asked. "Well," Will replied, "There's just under $500,000 in the account, and whatever else he hasn't gotten rid of to pay his lawyer. My research places it close to $750,000 give or take a few grand." He took a bite of his sandwich to let the numbers sink in. "Wow," Rick muttered. "It's enough to put Kyle, Charlie and Ry through college and get a new house." "This just seems too unreal," Rick said, unable to hide his doubts. "It seems too flawless, too perfect." "It's not, actually," Will said. "If Dan is found not guilty, the civil suit will be harder to prove. If Ry doesn't testify against Dan, it weakens Kyle's testimony, since there was no recording that day. And everything comes down to how hard Dan fights the civil case, provided he can get the time in prison. Most prison law libraries are too busy to allow inmates to do civil suits, so that can work in our favor, but there's still too many variables." "So, Ry has to testify." "In the end, yes. The videos should be enough to do it, but the jury needs to hear the voice from a victim, but Kyle's testimony regarding the attempted rape is only as strong as Ry's statements." "So, why prevent Dan from taking a plea bargain? I'd rather he go to prison before Kyle or Ry have to testify." "If Dan takes a deal, he'd get a lighter sentence. Doing it this way, Dan could face a lot more time, and I mean A LOT more. Dan's charges would put him away for the rest of his life. If he took a deal, the D.A. would drop some to most of the charges, reducing Dan's time in prison, and there's a chance that the charges for Kyle might be part of what gets dropped. By doing this, he has to face every minute of his conviction, and if he happens to get out early, he'll be completely broke. Luckily, there's a good chance he'll be found guilty." "When do I have to testify?" Kyle asked. "I'm not sure," Will said. "I believe Ms. Marshall was going to call you the same day as Ry, but now, I'm not sure what her plan is. I'll know more tomorrow, and we can go from there." "Is it alright if I stay here tonight?" Rick said, "I don't know, Buddy. Will and I have to work, and I don't think the hospital would want an unaccompanied minor here." "Can you ask? I don't want to leave Ry or Charlie by themselves." "Sure," Rick said. "I can ask, but don't get your hopes up, okay?" "Okay." The nursing staff agreed with Rick that it wasn't a good idea to leave Kyle at the hospital without an adult. Will went back to his apartment, while Rick took Kyle home. "Hey," Rick said, pulling Kyle into his arms. "How are you doing?" "I'm okay," Kyle said, wrapping his arms around his dad. "I'm really tired, but I'm glad Ry is awake and Charlie is doing better." "Does it bug you that your brother is sleeping with your boyfriend?" Rick joked. "Don't," Kyle said. He knew Rick was trying to lighten the mood, but he didn't find the joke funny. "Sorry," Rick. He kissed Kyle on the head and hugged Kyle tightly. "Can I sleep with you tonight?" Kyle asked. "Of course, Baby." "I mean, like, actually sleep...and not have sex." Rick paused. "Yeah, of course, Buddy. Whatever you want." "Thanks," Kyle said, and he gave Rick as much of a reassuring hug as he could, given his emotional state. "Are you sure you're okay? You can talk to me about anything." "I know," Kyle said, breaking their hug. "I'm just really tired." "Okay," Rick said. He leaned in to kiss Kyle on the lips, but Kyle, ever so slightly, turned his head away. It was subtle, but Rick got the hint, so he kissed Kyle on the forehead instead. They went to Rick's room, stripped down to their underwear and got into bed. Rick started off facing away from Kyle, his heart breaking a little, then Kyle asked, "Dad? Can you hold me tonight?" "I would love to," Rick replied.
