Steve and I were lounging on the big couch while, Colby and Sean cuddled on the love seat. And, of course, Aaron and Connor were sitting together in the oversized chair. By the time the movie was over, most of us were yawning, every couple of minutes. Steve and I hugged all the boys good night before heading to our bedroom. The boys each got ready for bed and said their good nights. Colby and Sean went to their room, while Aaron went to Connors room and climbed in bed with him, which has become the norm when he stayed the night at our place. There wasn't much more than a little touching here and there in any of the bedrooms. Everyone was pretty tired from our long day out at the ranch, so everyone seemed content with some cuddling before drifting off to sleep. ********** Chapter 51 ********** Before we realized it, Dennis' trial snuck up on us. I had noticed that Colby seemed little quiet the week before the trial was scheduled to begin. I'm sure that everyone in the house noticed it as well, but no one made a big deal out of it. We all knew that if Colby wanted to talk about it, he would start the conversation. Steve and I were both planning on being at the trial, and had made arrangements at work, so we could be there. I had spoken with the prosecutor, who had told me, they didn't expect the trial to last more than three or four days. The weekend before the trial, I pulled Colby to the side, while we were at the ranch, and asked him if he wanted to attend the trial or not. He told me that he didn't think he would, unless Sean had to testify. Colby said he would go to support Sean if, Sean had to testify. That night after we were all settled in the living room watching a movie, I noticed Colby get up and go into his room. He was gone for almost an hour, and both Steve and I noticed Sean looking back at the door to their room, as if he wanted to go see what was wrong. Later that night as everyone was getting ready for bed, I was in the kitchen, when Colby came in to get a drink. I asked, "Is everything alright with you? You missed most of the movie earlier." As Colby was getting his water he answered, "I was talking with my mom on the phone. We were talking about whether I should be at my dad's trial or not. I told her that I hadn't planned on being there unless Sean had to testify. She was glad I'm not going. She said she didn't think it would be good for me to see, and hear the things that my dad did. I told her that as far as I was concerned that Dennis is no longer my dad and that I have two great dads here." I noticed a tear running down Colby's face, as I pulled him in to a hug. As I squeezed him, I said, "Your a wonderful kid, and Steve and I are lucky to have you in our lives. No kid should have to be going through what you are. Just know that we are all here for you, and will be standing next to you no matter what." We both squeezed each other one more time before we went off to our separate bedrooms. I told Steve what had happened and what Colby had said. As we laid in bed, with Steve's head resting on my chest, we talked about what an amazing kid Colby was, and how much support he will need over the next few weeks. Monday came around and the trial was to begin. I knew from testifying in many cases through my years as a police officer that, at least the first half of the first day of Dennis' trial would be tied up with picking a jury. When I talked to the prosecutor the week before, he told me that Dennis had requested a jury trail. The prosecutor suspected Dennis' lawyer was hoping to get one or two older men on the jury, who would be more likely to be sympathetic to Dennis' belief that Sean had made Colby gay. Steve and I had taken the whole week off so we could be at the trial. Once we got the boys off to school we took our time getting ready to leave for the court house after lunch. Of course we took advantage of having the house to ourselves, taking a nice hot shower together, with a lot of making out and exploring hands. This of course led to some very hot love making followed by a short nap, before actually getting ourselves ready to leave. We arrived at the court house and sat outside the court room waiting for things to begin. The prosecutor, Mr. Jones, motioned for us to follow him into the court room. I noticed he was carrying a pretty good size file and some other stuff that looked like diagrams and such. Once inside, Mr. Jones told us court would start in about thirty minutes and said they had seated a jury of six women and four men earlier. As we were speaking with Mr. Jones, Brain and his folks entered the court room. They walked up to where we where standing with Mr. Jones. Everyone shook hands and then Mr. Jones started to explain to Brian and his parents that he believed that they would only make it through opening statements today, so he didn't think any witnesses would be called today. He also explained that he expected Dennis' attorney to invoke the rule for any witnesses to be called so Brian would not be allowed to be in the court room during the trail except to testify. He then told his parents that they would be allowed to stay, but they could not talk to Brian about anything that was said in the court room until after the trail was over. As we were all talking, Dennis and his attorney came into the court room. Dennis was dressed in his class A Army uniform, even though this case had nothing to do with the Army. I also saw a couple of other men walk in behind them, also in their Army class A uniforms. I assumed that they were either Dennis' chain of command or friends that might be character wittiness's. Soon after everyone was in the court room the court bailiff called the room to order and everyone stood as the judge walked into the court room. After he was seated he told everyone to take their seats and then asked to two attorney's to step forward to speak with him. Of course no one could hear what was being said but could see all three speaking between each other. After a few minutes the two attorney's returned to their seats. The judge then asked the bailiff to bring the jury in. We all watched as the jury walked in and each took a seat off to the right hand side of the room. Once they were seated the judge first looked at them and thanked them for being there and doing their civil duty by serving on this jury. The judge then asked both attorney's if they were ready to proceed and they both stated they were. Dennis' attorney stood and stated he would like to invoke the rule. The judge granted his motion, then asked everyone in the court room that was there to testify to stand. Brian was seated right next to me, who stood. As I looked around the room I noticed the two Officers that walked in with Dennis earlier both stood along with Officer XXXXX and the ER Doctor that had treated Sean, had all stood. The judge explained what invoking the rule ment and explained that they would be asked to wait in the witness champers until called to testify. He also explained that they were not allowed to talk about the case to anyone except the attorneys. Once he finished he asked all of them to raise their right hands and asked the court recorder to swear them all in at one time. With one more reminder about talking about the case he asked them all to exit the court room. Once all the witnesses had left he court room, the Judge asked Mr. Jones if he was ready to proceed and Mr. Jones stood and stated the state was ready. The Judge nodded and then Mr. Jones introduced himself to the jury, also thanking them for their civil service. He then stepped around to the front of his table and began speaking directly to the jury. Over the next twenty minutes, Mr. Jones spoke about the evidence the state would present to the jury. Mr. Jones spoke in vague terms but indicated that he would show that Dennis had conversations with a fellow student of Sean's about how Sean was gay and had turned Dennis' own son gay. Mr. Jones also stated he would show that Dennis performed surveillance on Sean to learn about Sean's movements around school, and gave the other student Sean's schedule. Mr. Jones also told the jury that they would hear from the ER Doctor who treated Sean's injuries and how serious those injuries were. Mr. Jones ended with telling the jury that even though Dennis didn't actually assault Sean, he was just as responsible for what happened. As Mr. Jones was speaking, I noticed that he never mentioned Brian's name and never said anything about Brian being the student that assaulted Sean. I also noticed that Brain's mother had a tear running down her cheek and could only imagine what she and her husband were going through. I knew that they were going to have a hard time hearing what their son did to Sean. Once Mr. Jones finished his opening statement, it was Dennis' attorney's turn. He also introduced himself to the jury and thanked them. I hadn't ever heard of this attorney, so I suspected he was from out of this area. Maybe Austin or Houston. Mr. Clark only spoke for about ten minutes and basically went through each point that Mr. Jones had raised, telling the jury that the state only had circumstantial evidence about Dennis' actions and stated that the student that assaulted Sean had acted on his own accord and Dennis had no idea of the student's plans. Mr. Clark ended with explaining to the jury that if Dennis had no idea of the student's plan to assault Sean, that they could not hold Dennis responsible. Once Mr. Clark was finished the Judge looked at this watch and stated court would be in recess until nine o'clock the next morning when Mr. Jones could call his first witness. With that he dismissed the jury after he reminded them that they were not to speak to anyone about the case. Once the jury was out of the room he asked the bailiff to remind the witnesses about not discussing the case with anyone before he released them. With all of that said the Judge dismissed court for the day. Everyone made there way out into the hallway. We all waited for Brian to emerge from the witness room. Once there Mr. Jones asked Brain to be in his office at eight the next morning to go over his testimony before court, since he planned to call Brian as his first witness. Mr. Jones looked over at Steve and I, and told us that there was no need for us to be there until court stated at nine. Steve and I shook hands and said our goodbyes to Brian and his parents before we headed home. That night we didn't talk about what happened in court, except to say that the opening statements were finished and Brain would be testifying first thing in the morning. You could tell that the trial was on everyone's mind. Even with Aaron over for dinner, it was very quiet.
