I made breakfast then made a bottle for him and sat and fed him while I waited on the boys to get up. I finished feeding him just as Alex and Dennis came down to eat. I put him in the bassinet for a nap then ate breakfast. Once we finished I cleaned the dishes. About 10am there was a knock on the door. There was a sheriff deputy and a lady in a suit. She introduced herself as with Child Protective Services. * * * * * Young Again: The College Years - Chapter 66 by Sam She said there was a complaint about possible unfit parents. I asked who made the complaint. She wouldn't say. I asked what the complaint said. She said there was a child being raised by unmarried gay people. I asked her what exactly was unfit about that. She wouldn't elaborate but said she was coming in to check everything out. The sheriff deputy forced their way in. I called Marty and had him come over immediately. He ran over. The lady looked around for a few minutes then said it was an unfit environment and said she was taking the child. I was about to cut a bitch but Alex and Dennis held me back. Caleb was screaming as they took him out the door. I couldn't believe what was happening. Marty was on his phone. I couldn't control myself and broke down. Both Alex and Dennis held me. When Marty got off the phone he said my lawyers were working on it. I just turned and walked upstairs and got in bed. At lunchtime Alex brought in a plate of food for me, but I wasn't hungry so I didn't eat. The same thing happened at dinnertime. All I wanted was Caleb back. When it was time for bed, Alex and Dennis came in and cuddled up to me. Sleep did not come easy for me. The next morning they got up but I stayed in bed. When Alex brought in breakfast I didn't eat anything. "Babe, you have to eat something." "Not until I have my child back." The same happened at lunchtime. Around 2pm Marty came in the room and said my lawyers had set up an emergency hearing for Monday at 10am. I thanked him and he left. It's only Thursday, I have a long wait. When Dennis brought in dinner I told him about the hearing. "What about school baby?" "We are not leaving here without my child." He left and I laid down. I'm not hungry, I need my baby. When Monday morning came I got up and got a shower then put on a suit. When it was time to leave Alex drove me, Marty and Dennis to the court. We got there and my lawyer was there. I talked to him and he explained how things would go. He looked at the complaint to CPS and said it was unfounded and would easily be thrown out if the judge was reasonable. When it was time we waited at the table and the bailiff told everyone to stand up. We did and the judge entered and sat down at the bench and told the rest of us to do so. The judge asked the CPS lawyer to make his case for the child to be kept out of our custody. He went on about me and Alex being unmarried and gay and how a child needed a mom and dad. The judge asked about any problems in the living conditions but the attorney had no information on that. Which he wouldn't as the CPS lady hardly looked at anything, but we did the baby proofing as part of the adoption process so there was nothing to complain about anyway. Then the attorney said we must have done something to the child as it hasn't stopped crying since it was taken into care. I whispered to my lawyer. After CPS made their case it was my lawyer's turn. He started with the state having a non-discrimination law for sexual orientation so the fact we are gay could not be used against us. Also he asked for CPS to reveal if they take away the children from unmarried straight couples or single parents. CPS refused to answer. He then said that the environment was appropriate and already made safe and produced the invoices from the baby proofing company we used. Not sure how he got that, my guess would be Marty though. The judge looked over the invoices. My lawyer then told the judge that my child has never cried once while in my care and if he is crying now, it is because of CPS. The CPS lawyer scoffed and said all babies cry. The judge rebuked the attorney for speaking out of turn then looked at my lawyer and asked if this was true. My lawyer said yes it was. He had statements from the hospital staff stating that the child did not cry while in the hospital. The judge looked these over closely. He then asked the CPS lawyer if the child was available. CPS said it was, but was crying so wasn't in the courtroom. The judge said to bring the child in. A few minutes later a door opened and a lady with a screaming Caleb came in. I wanted to run to him but my lawyer put a hand on my shoulder. My lawyer asked the judge if it would be alright for me to hold my child. CPS said that would endanger the child. The judge asked the CPS lawyer to explain how. He couldn't. The judge told the lady holding Caleb to give him to me. I took Caleb from her and held him in my arms. He had his eyes closed and was screaming at the top of his lungs. I gave his nose a poke and he opened his eyes. When he saw me he stopped crying. I rubbed his tummy and he started to smile. "Pop" The judge asked what the child said. My lawyer told him "Pop". I whispered to my lawyer and he relayed that it was my child's name for me. The judge looked at the CPS lawyer and asked if he had any other evidence that I was a bad parent as he was getting ready to make his ruling. The CPS lawyer said he had given all the evidence and it was enough in his mind. The judge asked my lawyer if he had any other evidence. He asked what more evidence he needed while motioning to me holding Caleb and him smiling. The judge said he would go deliberate and would return. When he left Caleb got a serious look on his face. "Are you ok Caleb?" He shook his head. "What is wrong?" He put his hand to his rear. I opened his onesie and pulled open his diaper and there was a huge black bruise on his butt. "What happened?" "Hit" I showed my lawyer and told him what Caleb said. He got up and went to the bailiff and the bailiff went into the judge's chambers. Seconds later we were told to stand and the judge came out and went up to us. He asked to see the bruise. I showed it to him. The judge went back up to the bench and looked right at the CPS lawyer and asked why Caleb had a bruise on his bottom. The lawyer was shocked and said he was unaware but would find out. The judge said he had 5 minutes. Five minutes later and the lawyer says the foster parents have told him that Caleb fell from the changing table because he was moving around too much. Caleb shook his head. I whispered to my lawyer and he informed the judge that the child says that is not what happened. Hearing this the CPS lawyer scoffed and said my child is only a month old and cannot tell us what happened. My lawyer smiled and asked if we could put my child on the stand. The CPS lawyer laughed and said he had no objection. The bailiff came over and I told Caleb to tell the truth and handed him over. The bailiff took him over and instead of putting him in the witness box, gave him to the judge. "Caleb, we are going to do this a little different. I'm going to talk to you and if you can, just answer my questions in your own way. Is that ok with you." Caleb nodded. "Let the record show the child nodded in the affirmative." "Caleb, did you fall from the changing table at your foster parents' house?" Caleb shook his head. "Let the record show the child shook his head in the negative." "What did happen?" "I... wa.... s... cry... n... and... th...ey... sa... id... if I do... n... t.... stop... they... wou... ld... make me. They took a b... bat and hit me with it." "They hit you with a bat?" Caleb nodded. "Let the record show the child nodded in the affirmative." Let's just say right now the foster parents were lucky they were not in the courtroom as 4 people would have killed them at this point. The judge thanked Caleb and told the bailiff to give him back to me. I held Caleb tight when I got him back. The judge looked at the CPS lawyer and asked if it made sense to him to take a child from loving parents and put them with foster parents that hit the children with bats. The CPS lawyer did not have an answer. The judge gave his ruling. "I find that Sam and Alex Peters are fit parents and order Caleb Peters to be placed in their care immediately. I also find that CPS is in violation of the state non-discrimination act and fine them $50,000. I am issuing a restraining order for all CPS employees to stay 100 yards from Sam and Caleb Peters. I am also issuing a bench warrant for the foster parents for child abuse. It is so ordered." The judge then banged his gavel and we were told to stand as he walked out of the courtroom. My lawyer escorted me and Caleb out of the room with the other three following behind us. "This happens again Sam just call me and I'll nail them to the wall." I thanked him and Alex and Dennis walked on either side of us as we went to the car. We were almost there when the CPS lady that took Caleb walked up to us. "You may have won this round, but we will get that baby." "Dad, do you have your gun?" "Yes kiddo I do." "If she touches Caleb, shoot her." "Will do kiddo." Marty drew his gun from his shoulder holster. The CPS lady backed off and we went to the car. Once we were in I told Alex to drive to the lab so Caleb could get checked out. Marty called the doctor to let them know we were coming. When we got to the lab we went right in. Doctor Winters came in and asked to look Caleb over. I removed his onesie and his entire back was a bruise. We also removed his diaper. It was just one big bruise from his shoulders to his butt. The doctor said he wanted to get x-rays to make sure nothing was broken. He took Caleb and we waited. About 10 minutes later and the doctor was back with Caleb. I held Caleb while the doctor went over the x-rays. The doctor said there were a few small fractures but those would heal on their own. He also said the bruise will go away on its own as well. I set Caleb down and put his diaper and onesie back on. We left and headed home. When we got home I took Caleb upstairs and to our room. I got in bed and put my back against the headboard and held Caleb in my arms as I rubbed his tummy. About twenty minutes later Dennis came in. "Baby, can we talk?" To be continued...
