Chapter 26, Damn Answering Machine

After lunch on Labor Day we packed up everything going back to Seaside. Two bicycles, perishable foods including the top tier of our cake, our wedding attire, and what little other clothing we had brought. The whole Washington gang, all 10 of them, took off together for Los Altos. We got everything put away that we didn't want available to renters and locked it into the Owner's closet. The unit was booked the next 3 straight weekends. The resort housekeeping crew would be in to wash the sheets and towels, remake the beds and do general cleaning. The last 3 carloads headed home, but I had to stop at the office, so Steve and Susan went ahead, my parents waited and would follow me home in their rental car. It took about half an hour in the office.

We got home about 3:30 Monday afternoon after dropping my parent's rental car at the airport. My parents were obviously shocked when they saw our house. From the driveway side, it's pretty nice, but when you get inside, it gets really impressive. They were staying a few extra days, so I convinced Donny (again) to give up his room and we got them situated. When I walked by my office, I saw the light blinking on my answering machine, but figured it could wait since nothing is open today being Labor Day.

I was giving them the tour when I heard the security monitor beep. It was Steve and he looked to be in a hurry. Seconds later, he was knocking at the front door.

Donny, who had wasted no time at all shucking his clothes opened the door. I used the intercom to tell him I'd be there in a few minutes. He went to my office to wait.

I left my parents in the family room and went back upstairs to my office. Steve was pacing the floor when I walked in.

"Have you listened to your messages?"

"No, why?"

"Jimmy's been trying to get in touch. He's called me 5 times."

The answering machine was blinking 54 in the messages window. "Holly shit, I've got 54 messages."

"Start playing them."

I pressed `Listen.'

Message 1: "Hi, This is your favorite lawyer. I just wanted to congratulate you. You and Steve are a corporation. Million Dollar Homes is in business. I've filed all the paperwork and everything's good. I'm mailing you copies so you can open your bank accounts. Call me if you have any questions"

Message 2: "This is Sue from Dana Point Escrow Company. The escrow on your Dana Point property is ready to close. We just need you to come in sign a few papers and we'll be complete. Thank you.

Message 3: Hey this is Jimmy. What did you buy? I got people from Dana Point tying up my lines wanting to talk to you. Call me before you return their calls. Dude, you stirred up a hornet's nest.

Message 4: Holy shit Aaron! You bought the most sought after beach front property in Orange County! Everybody wants your ass. Call Me!

Message 5: Mr. McKinney, this is Dominic Howard, the Property Development Manager of Ritz-Carlton Hotels in, Bethesda, Maryland. I'm calling on behalf of Alistair B. Johansson, I need to speak with you about a property you recently acquired in Dana Point, California. Would you please call me at 240-867-5309.

Message 48: Jimmy again. Aaron, this is important. Call me at home whenever you get this.

The rest were all repeat calls.

I called Jimmy at home. Jimmy answered. "Hi Jimmy, you're on speaker phone with Steve. I understand you've been trying to reach us."

"No shit Sherlock, where the hell have you been? I've been calling since last Tuesday."

"For which I'm sure you're going to bill me. Sorry, Jimmy, I've been out of town getting married."

"Oh, well, good for you. You know how many calls I've take on your behalf?"

"Yes, if your calls are anything like my message machine, I had 54 messages when I walked in."

"You've got a bunch of people with their panties all twisted up over this land purchase you made. First thing tomorrow morning get down to the escrow company and finalize the escrow before someone steps in and messes things up. No, wait I'll meet you there. Can you be there at 9 AM?"

"Calm down Jimmy, Steve and I just got home an hour ago. We can make it to escrow company tomorrow. Would you like to meet at my house for breakfast? We can all drive down together.

"That's not a bad idea. I can fill you in on that's going on. Did you really buy this property for $800,000?

"Yeah. And who is Alistair B. Johansson and why is Ritz-Carlton Hotels calling me?"

"Alistair is the owner of the Ritz-Carlton hotel chain. They want to build a hotel, and you just pulled the rug out from under their plans by buying some of the land they need. I'll tell you all about it tomorrow. See you at 7:30, have coffee ready."

Tuesday was supposed to be about getting the kids ready for school, but now I needed to meet with Steve, Jimmy, and the escrow company. So I worked it out with Jenifer that she and my parents would take the kids shopping for new clothes and school supplies, which included uniforms for Donny, only available at the school.

Jimmy was prompt, buzzing the gate at exactly 7:30. Steve came down as soon as he saw that Jimmy was there. I had gotten up early and had a fresh pot of coffee in the kitchen and the carafe in my office was full. We went to the kitchen for coffee and bagels with cream cheese and coffee, then to my office to talk.

Jimmy explained what had transpired in our absence. "When escrow filed the public filing of the title transfer, the calls started. The city was all over me, because of the DBA I had filed listing your names forming the corporation. Of course I didn't know anything about your little land purchase so I just played dumb which is what lawyers do best."

"And you're so good at it," I added.

"Thank you. I started digging through my construction connections and found that a developer, and the city of Dana Point have been quietly working in the background for a couple years planning the development of that parcel of land. The city planned to acquire it as soon as it became available.

"The city has also been working with William B. Johansson who recently completed acquisition of the Ritz-Carlton Hotel name. He's been negotiating with the city to build a major hotel/resort adjacent to the north end of the property you bought, but their design needs 53 feet of your land or they lose like 80 rooms. Mr. Johansson has offered you $1 million for those 53 feet.

"The California Coastal Commission is involved because beach access is required by state law. That beach is one major surfing beach. They and the city want the south end of your land for a parking lot, a small park, and a road down to the beach.

"I haven't seen it, but supposedly there is a detailed plot-plan that has received unofficial preliminary approval from all concerned showing the hotel, the subdivision, the park, the roads, infrastructure, everything. All they were waiting for was for the doctor to die. The city was waiting for probate, they didn't know the daughter had power of attorney and she sold it to you using that authority. And they're pissed."

"What's our negotiating position?"

"The city can condemn the property under eminent domain, they would have to pay you current market value, but then we'd appeal and we could tie them up for years in the courts, so that would be a dumb move."

"I offered an idea, "Why don't we suggest they hold a meeting with all concerned parties. We'll go in as the innocent good guys more than willing to be community advocates. We'll accept Ritz-Carlton's offer. We'll give the city the south end they need to make California happy. We'll purchase the plot-plan the development company has prepared, paying all their expenses to develop it and a modest profit on top of that.

"For our full cooperation, the city departments will fast track the sub division of the property according to an approved plot-plan and all permits and inspections related to the sub-division. They are to install or upgrade as required, sewers, gas, water, power, street lighting, street pavement, curbs and sidewalks and any other city related services I might have forgotten. And Million Dollar Homes will build the houses over the next couple years.

"Shouldn't that make everybody happy?" I asked.

"That's not bad. I like it. The only entity that won't be completely happy will be the developer, he loses out on a large potential profit, but at least you're offering him a profit on the work he's done. He'll have to agree to it or the city will cut him off from ever working in Dana Point again and the snowball effect of surrounding cities will effectively put him out of business, at least in Southern California."

"So, now that we're a corporation, how do we move this property from my name to the corporation?"

"Oh, that's easy, that's why I'm going along this morning. We'll do it at the same time you sign the escrow papers. I have all the documentation."

We continued talking about the project for another half hour. Donny came down for breakfast and noticed our meeting and stopped to say hi to Steve. "Put some clothes on, Donny, we have a guest." Instead he came in and introduced himself to Jimmy.

That reminds me Jimmy. There's another business opportunity I'm considering. It would be a retail store specializing in security systems. It's a couple of friends with no money working part-time out of a garage and part time for Best Buy. I want to move them to PCH in Laguna Beach. Million Dollar Homes will use them as consultants incorporating high tech electronics in home designs then as a sub-contractor to install them. All the while, they would continue to offer their products and services to retail customers. Could MDH be a silent partner so they could be part of the benefits we offer employees, or what?

"There's a few ways to do that. I'll look and see which will work best for you.

"And one more thing, I'm considering hiring a live-in housekeeper. What's the best way to employ her and cover her with insurance? Could she be an employee of MDH so I could offer her health insurance as well?"

"I'll look into that as well. Shall we head down to Dana Point?"

We took my Suburban for the short drive down the coast. We signed all the paperwork and MDH was now the owner. On the way home we stopped at a Laguna Beach bank to set up the two accounts. Jimmy provided all the paper work the bank required and checked over the forms before we signed them. I wrote checks for my investment in MDH of $1,000,000 less the equipment purchase of $400,000. And a second check to the investment account for $5,000,000 less the property at $800,000 and change for the taxes and escrow fees. We ordered printed checks for both accounts and they gave us some temporary checks. We also discussed credit or debit cards for ourselves and for our crew leaders. We were assured it would be no problem.

We went back to my office and Jimmy used my speaker phone to call. "Mr. Mayor, Good morning. This is Jimmy Patterson, lawyer for Million Dollar Homes which includes Mr. Aaron McKinney and Stephan Zee as partners. I have spoken with my clients who just returned from Aaron's wedding this past weekend."

"So that's where everybody's been. Please, offer him my hearty congratulations."

"Yes sir, I will. My clients are very anxious to move forward with this. They look forward to working with the city. We would like to suggest that you host a meeting with all the concerned parties at city hall at your convenience so we can discuss the situation and come to an acceptable agreement. And just to keep you fully informed. The corporation that actually purchased the land did close escrow this morning. Million Dollar Homes is now the holder of record of the deed.

"That's a wonderful idea Mr. Patterson, let me look into how soon I can get everyone together and I'll get back to you."

"Perfect Mr. Mayor, I understand a developer has a completed plot-plan for the area that has unofficial preliminary city approval. My clients are willing to purchase the plot-plan the development company has prepared, paying all their expenses to develop it and a modest profit on top of that. And in the spirit of full disclosure, we also have a generous offer from Ritz-Carlton for the portion of the land they need to complete their design of the hotel/resort, on the north end, and we are prepared to accept that offer."

"That sounds wonderful, that hotel has been in the works for 2 years and Dana Point is anxious for it to begin construction."

"We're glad to hear you are willing to work with us. Please call me as soon as you can arrange the meeting. And if you could sir, please have your other departments stop calling my clients. Mr. McKinney had 54 voice messages through last night, and has 3 more already today already. I've instructed him to refer all calls about this project to my office for now.

"Yes, of course, I'll make a few calls today, get those calls stopped and a meeting set hopefully later this week. Since you're happy with the Ritz-Carlton offer, is there any reason for them to fly out for this meeting?"

"No, I don't believe so, but I pity the person who would have to call Mr. Johansson and tell him the hotel plans are on hold again if we can't reach an agreement. But I don't expect there to be a problem, Million Dollar Homes is looking forward to a long enjoyable relationship with Dana Point. Thank you for your time and I look forward to your call. Good bye Mr. Mayor.

I pressed the button hanging up the call and we all just looked at each other.

Jimmy spoke first, "That was fun! We've got them by the balls. I gave him just enough information so they know that we've got them by the balls. This is going to be a fun meeting."

"Are we asking that much of the city?"

"Not much that is out of the ordinary, sometimes the developer does the street, but not that often in a small development like this one. I don't see them making too big a fuss, there's too much at stake. Ritz-Carlton is a $20 million hotel with huge tax income for the city, and the property tax income from the homes you'll build."

Steve brought up a possibility, "I wonder if the developer has any prospective buyers for any of the lots or maybe even some home designs already completed. I know I would at this point. Let's bring that question up at the meeting if the developer is there. We might be able to purchase those designs and those customers as well.

I asked, "Steve, when do we need our own architect?"

"Soon. Sometime after this meeting and we find out what's happening."

"OK, Jimmy. This is outside your area of the law, but I don't know where to start. Jenifer and I were married this past weekend. What will it take to change her daughter's last name to McKinney?"

"Where's her father?"

"Deceased."

"That makes it a lot easier. You just need to fill out some forms and file them with the court. Want me to take care of it?"

"Yeah, would you."

"I'll get the forms, everybody will need to sign on the right lines, and I'll file them with the court. You all may need to appear before the judge for it to become official."

Jimmy left for his office and Steve went home, and I was all alone.

I called a friend who was a member of an antique car club. I told him I had a 1956 Chevrolet Bel Air and a 1924 Rolls Royce Silver Ghost Pall Mall Touring Car that needed work. He recommended a car restoration garage in Pasadena near the Rose Bowl. They were the best in the business, fair, and honest. I called told them what I had and what it looked to me that they might need from my visual inspection. They agreed to send their car hauler to pick them up. We made an appointment for 10 AM Wednesday.

The mayor was good to his word, all the phone calls did stop until I got a call from Jimmy setting the meeting for Sept 12th a Friday morning at 9:30. We arranged it again where Jimmy would stop at Seaside and we'd drive down together, but he had to bring donuts to go with the coffee.

The shoppers finally returned home. For nudists they sure did buy a lot of clothes, Karen was toting the most, probably 6 or 7 bags. Donny had 3 bags and a tennis racket, one bag had the Oxford Hill logo. Jenifer had several bags too. She claimed she would need the clothing as part of her persona as an interior decorator. Donny stopped to show me what he got. 5 polo shirts each a different color (red, blue, dark green, maroon and purple) all with the Oxford logo on the left breast, 2 white polo shirts for P.E. with the same logo, and 5 pairs of black slacks and 4 pairs of white shorts with white web belts, one pair of tennis shoes for actually playing tennis while wearing them, and 2 pairs of Vans for regular wear.

He explained, "Mr. Obershire saw us at the school store and gave us a quick tour where I saw the tennis courts I told Mr. Obershire that I liked tennis and he said I could take tennis lessons as my P.E. requirement, so he's changing my schedule for me. So then I needed a racket, so I got this one cause the tennis teacher recommended it."

"When did you meet the tennis teacher?"

"When Mr. Obershire took us to his office."

"Oh, I must have missed that part. So are you ready for school to start tomorrow?"

"I can't wait."

"Well I'm going to take you to school tomorrow, then I'm going to the doctor's house and bring home the boxes of medical books and equipment."

Today's going to be a busy day. Kid's first day of school, cleaning out the doctor's house, pick up the housekeeper and interviews of each other.

Before heading out the door, we took the obligatory 1st Day of School photo snapshots. All 6 of us piled into the suburban and headed toward downtown and Laguna Beach High School where Karen was entering as a freshman. There is a lot of money in Laguna Beach and high school is one place it becomes obvious. We got in the back of the line to let Karen out at the drop-off zone. Every car in front of us was either a Mercedes, BMW, Porsche, Lincoln Continental, or Jaguar. Ok slight exaggeration, there were a couple Ford Escorts and we were in a 1976 Chevy Suburban.

This was supposed to be a no drama drop-off. No kissing allowed. No calling out to her after she got out. We were to just drive away. The goal was no parental embarrassment in front of her classmates. We did what we were told, and headed south towards Oxford Hall, twenty minutes or so away on the outskirts of Laguna Nigel.

There was a banner welcoming us to Oxford Hall Academy at the front gate. We followed signs directing us to `New Students.' A man appeared at my window asking for the student's name, and I replied, Donny McKinney. He called out a name and a middle aged woman appeared saying right this way Donny. She led him away. My little boy was on his own. We followed the arrows around and back onto the road south.

20 minutes later, I parked on the dirt road behind the house on Strand Beach and let ourselves in. There was junk everywhere, but as we looked through it, we realized it wasn't all junk, but what looked like maybe, valuable antiques. His daughter did tell me he accepted bartered items for his services. There looked to be a lot of Chinses vases and other porcelain items. I knew at that point, I would need to get the antiques appraised before the house was torn down. We packed up a few of the more ornate pieces then set about to finding the medical stuff for Donny.

We folded the large side of the middle row of seats down then filled the space between the front seat and the tailgate. We were even able to get the old leather-covered exam table with all its moving parts and cabinets and drawers strapped across the roof. By the time we finished, we were full to the ceiling.

While we were doing that, the guy from the antique car restoration garage in Pasadena showed up. He was about 65, and when he saw the Silver Shadow he recognized the car. He had done the original restoration work 30+ years ago for the doctor. My dad and I helped him push the cars out of the garage to where they could be loaded on the car hauler trailer. He looked over them and declared them to be in pretty good condition, requiring only minimal restoration. The 1924 would need a new top and seat covers, both would need new tires, and both needed some interior parts replaced that had cracked over time. The paint looked good, but only cleaning would tell the whole story. He promised to have an estimate for me by tomorrow afternoon.

We took a break and sat on the dining room chairs that we took out on the porch overlooking the ocean.

My dad finally asked the question I knew was coming, "Son, how is it that you can afford all this, your new house in Laguna Beach, this house, private school for Donny, and the Hang-Out? Heck, your house alone must be a half million dollars!

Jenifer and I both smiled at his last comment. "Dad, I think you're applying Ohio based economics to values here in Southern California. Seaside house was 1.4 million. This house as a tear-down and the land under it, is worth about $450,000, but we also bought all the open land on either side. Total value about $20 million, but I only paid $800,000. Donny's school is $35,000 a year. The Hang-Out, purchased and custom built in Ohio, hauled to California, installed, and fully furnished was around $85,000. I partnered with Steve for and investment of 1 million cash and a 5 million account for land acquisitions.

"But how can you afford all this?"

"I won the lottery." Jenifer and I both know what I meant by that, but this is the lie we concocted to explain our sudden wealth. "A friend of mine moved to South Carolina a few years ago. He, another friend, and I have been playing the lottery ever since. We won a decent jackpot, $87 million. After federal and state taxes, each of us received a little over $15 million. That happened, just before Donny and I drove to Ohio so you could meet him.

"But why didn't we hear about it. All the jackpot winners make the newspapers."

"South Carolina is one of a few states where winners can remain anonymous, which we chose to do so. But it's all working out." I pointed to the bluff up the beach, "See that bluff? Ritz-Carlton wants to build a hotel up there, but needs 53 feet of this property. They've offered me $1 million for those 53 feet. The property is 1500 feet long x 500 feet wide. That's enough to build 30 or so houses. We'll be tearing this one down soon." Jenifer smiled at me for telling such a believable lie.
